The Law Applicable in the International Arbitration

Abstract:

Práce popisuje, analyzuje, klade a zodpovídá otázky týkající se práva rozhodného v mezinárodním rozhodčím řízení z pohledu práva nestátního původu (nestátní právní prostředky členící se na:Možnosti rozhodování,Lex mercatoria (jako systém práva nestátního původu)Obligatorní aplikace státního práva (např.: ius cogents mezinárodního práva soukromého a veřejného, veřejný pořádek). Práce ověřuje, že vzhledem k vysoké míře abstrakce institutu lex mercatoria je lepším řešením aplikovat konkretizovaný zdroj (či zdroje) lex mercatoria.

Abstract:

Thesis describes, analyses and (hopefully) takes questions about law applicable in international arbitration with the view of law of non-states origin (the law of non-state origin and its parts: Methods of disputes resolutions in international arbitration, Lex mercatoria (as a system a non-state law and issue that all sources of merchant law are applicable), Obligatory application of state rules of law (e.g. ius cogents of international private and public law, order public). This thesis verify that due to the high rate of abstraction of the term “lex mercatoria”, in science as well as in practice (e.g. different views of arbitrator and parties), it is better solution to apply a specific source (or list of sources).
