Abstract:
Práce se zabývá problematikou předsmluvní odpovědnosti (culpa in contrahendo), resp. její konstrukcí v českém právu. Problém je nejprve nastíněn na pozadí německého, rakouského a francouského práva. Následně je pojednáno o úloze rozebíraného institutu také v současných unifikačních projektech (UNIDROIT, PECL, DFCR). Abstract:
The thesis deals with issue of pre-contractual liability (culpa in contrahendo). First of all will be this issue discussed on the basis of German, Austrian and French law, furthermore also on the basis of unifications projects (UNIDROIT, PECL, DFCR). Main aim of the presented thesis is a construction of culpa in contrahendo in Czech law.
