Possible Limitations of the Free Movement and Stay in the EU for Nationals of Other Member Countries

Abstract:

V rámci problematiky volného pohybu osob v EU se diplomová práce se zabývá možnými omezeními práva pohybu a pobytu občanů členských států EU. Práce charakterizuje stěžejní legislativu EU, doplněnou o judikaturu SDEU. Celou diplomovou práci doplňují vybrané důležité případy z judikatury SDEU, které měly na rozvoj unijní legislativy značný vliv. Diplomová práce popisuje mj. snahy členských států právo svobodného pohybu osob omezit, argumentaci zúčastěných stran a následné vyřešení případu SDEU. Práce se také věnuje případům diskriminace nejen přímé, ale také nepřímé, jakožto dalším možných nástrojem k omezení práva pohybu a pobytu občanů EU.

Abstract:

Within the context of free movement of persons within the EU, the thesis deals with possible restrictions of law based on the movement and residence of citizens of EU member states. Thesis describes the key EU legislation, accompanied by CJEU case law. The entire thesis is supplemented by selected important cases from the ECJ case law that had a considerable influence on the development of EU legislation. The thesis also describes the efforts of Member States the right to restrict the rights of free movement of persons, the arguments of interested parties and subsequent resolution of the case to the CJEU. The thesis also deals with cases of discrimination, but not only with direct but also with indirect discrimination, which is another possible tool to resrict a law based on the movement and residence of EU´s citizens.
