Abstract:

Práce se věnuje problematice vlastnictví bytů a nebytových prostor, tedy zvláštnímu druhu vlastnického práva, jehož objektem je byt nebo nebytový prostor v kombinaci s obligatorním spoluvlastnictvím budovy. Práce si kladla za cíl zobecnit základní teoretická východiska právního institutu bytového vlastnictví, včetně popsání jeho zasazení do celkového systému vlastnického práva. Práce si rovněž všímá sporných míst de lege lata a navrhuje možnosti jejich řešení, a to i s přihlédnutím k názorům odborné literatury a judikatury. V neposlední řadě se práce věnuje i připravované rekodifikaci soukromého práva, kdy institut bytového vlastnictví, a vlastnické právo vůbec, dozná významných změn s přijetím nového občanského zákoníku. Text disertační práce je rozdělen, kromě úvodu a závěru, do sedmi částí. Část první se věnuje historickému vývoji bytového vlastnictví v Evropě a druhá část činí stručný exkurz do zahraničních právních úprav vlastnictví bytů v SRN, Rakousku, Švýcarsku, na Slovensku a v Ruské federaci. Třetí část je věnována obecným otázkám a principům vlastnického práva v České republice, rovněž v komparaci s návrhem nového občanského zákoníku. V části čtvrté se rozebírají teoretická východiska institutu vlastnictví bytu a nebytového prostoru. Autor se přiklání k menšinovému stanovisku, že česká právní úprava je sice ovládána teorií dualistickou, avšak její koncepcí vlastnictví bytů, v níž rozhodujícím předmětem je byt a nikoli dům. Pátá část je teoretickým zobecněním, dle názoru autora, optimální koncepce bytového vlastnictví, které je chápáno jako výlučné vlastnictví reálně vymezitelné součásti stavby s akcesorickým spojením společného vlastnictví k těm součástem stavby, které ve výlučném vlastnictví nejsou. Zdůrazňují se typické definiční okruhy daného problému, kterými jsou vymezení primárního a sekundárního předmětu, řešení rozhraničení mezi objekty výlučného vlastnictví a společného vlastnictví a způsob úpravy právních vztahů, vyplývajících ze společného vlastnictví. Část šestá je již plně věnována platné právní úpravě vlastnictví bytů a nebytových prostor v České republice, a to prostřednictvím rozboru základních institutů a vazeb zákona č. 72/1994 Sb. o vlastnictví bytů. V sedmé části se autor věnuje nové úpravě bytového spoluvlastnictví, která je obsažena v návrhu nového občanského zákoníku. Celkovou snahou této disertační práce je, aby její teoretické závěry měly obecnou platnost a našly své použití i v interpretaci sporných míst úpravy de lege lata i de lege ferenda.

Abstract:

This work deals with the issue of flat and non-residential ownership, in other words a special proprietary right the object of which is a flat or non-residential room combined with obligatory co-ownership of the building. The aim of the work is to generalize basic theoretical foundations of flat ownership as a legal institution, including the description of its position in the overall property law. The work also points to controversies in the eyes of applicable legislation and proposes possible solutions with respect to opinions of provided in expert literature practiced by the courts. Last but not least, the work also deals with the re-codification of private law that is being prepared and will bring major changes to flat ownership and property law as such when a new Civil Code is passed. In addition to an introduction and conclusion, the dissertation is divided into seven sections. The first section deals with the development of flat ownership in Europe and the second section briefly deals with legal provisions concerning flat ownership in other countries, namely in Germany, Austrian, Switzerland, Slovakia and Russia. The third section is dedicated to general questions and principles of proprietary rights in the Czech Republic, also in contrast with the new draft Civil Code. The fourth section analyzes the theoretical grounds of the institution of flat and non-residential ownership. The author observes that Czech legislation is dominated by the dualistic theory, namely by the concept of flat ownership in which the flat and not the entire building is decisive. The fifth section generalizes, in author's opinion, an optimal concept of flat ownership viewed as exclusive ownership of a practically definable portion of a structure, with joint ownership as an accessory attached to such portions of a structure that are not in exclusive ownership. This section emphasizes typical definition domains of the issue such as the definition of a primary and secondary object, boundaries between objects of exclusive and joint ownership and regulations applicable to legal relationships resulting from joint ownership. The sixth section is fully dedicated to applicable legal provisions on flat and non-residential ownership in the Czech Republic and analyzes the basic concepts and relationships of Act No 72/1994 Coll., on the ownership of flats. The seventh section is dedicated to new provisions on flat co-ownership as provided in the draft Civil Code. When considering the future legislation, the author reviews those parts of the amendment that might, in his opinion, result into difficulties when practically applied. On the other hand, he emphasizes parts he believes might have positive effects on the future legal provisions concerning flat ownership. The overall aim of this dissertation is to make theoretical conclusions that would be generally applicable and could also be used to interpret the discrepancies between the applicable and future legislation.
