The Concept of Rape
Abstract:
Diplomová práce se zaměřuje na objasnění pojmu znásilnění z hlediska morálky i práva, k čemuž využívá jak moderní pokusy o definici znásilnění, tak i poznatky z historie. Práce se dále zaobírá souhlasem, jeho podobami, funkcemi a jeho rolí u znásilnění. Poznatky z judikatury a ze zahraničních právních úprav jsou na závěr promítnuty do návrhu české právní úpravy znásilnění.
Abstract:
This thesis focuses on clarifying the concept of rape in terms of morality and law, using modern attempts to define rape and knowledge of history. The thesis than deals with consent, its forms, function and its role when it comes to rape. Finally, the knowledge from case law and foreign legislation is reflected in Czech legislation proposal.
