Children's rights protection: a philosofical and legal analysis

Abstract:

Práva dětí představují široký soubor právem chráněných zájmů a oprávnění, upravených v předpisech různých právních odvětví. Spojuje je základní myšlenka, a sice že dítě, jako každá lidská bytost, má svou důstojnost, hodnotu a základní práva. Vzhledem ke svému věku, tělesnému a duševnímu rozvoji a s tím související neschopností hájit vlastní zájmy samo, však navíc potřebuje zvláštní pomoc, péči a ochranu. K uznání právní subjektivity dítěte vedla dlouhá cesta. Práce čtenáři nabídne pohled na postavení dítěte ve společnosti, kdy až do zavedení povinné školní docházky se o samostatné kategorii dětství nedalo vůbec uvažovat. Děti byly pojímány jako malí dospělí, od útlého věku se účastnily života dospělých, pomáhaly rodičům v práci na polích, byly najímány jako levná pracovní síla, zajišťovaly zachování rodinného majetku a tradic. Změna přicházela velice pomalu, první právní dokumenty, týkající se dětí, zaujaly na poli jejich ochrany strategii, směřovanou výhradně k ukončení hmotného strádání dětí a dalšího života v neuspokojivých podmínkách. Až Úmluva o právech dítěte uznala dítě jako aktivní subjekt práv, rovnocenný s ostatními členy společnosti. Právní řád nabízí řadu prostředků, které z tohoto postoje vychází. Přesto v řadě kontextů moderní doby opět dochází k zvěcňování. dítěte. Byť k tomu již rodiče nejsou nuceni společenskými podmínkami, využívají stále dítě k uskutečňování vlastních potřeb. Dítě se může stát předmětem dohody u smlouvy o náhradním mateřství, může se narodit ze spermie mrtvého otce, rodiče mohou zvolit jeho pohlaví a díky metodám prediktivní genetické diagnostiky určit jeho další vlastnosti. Takto narozené dítě je možné v případě sporu rodičů o péči o něj „exekuovat“. K potvrzení hypotézy o instrumentalizaci dítěte směřuje hlavní úsilí předkládané disertační práce.

Abstract:

An issue of children’s rights comprises a set of interests and demands protected by law that is regulated by legal acts from different areas of law. What they have in common is an idea that children are fully entitled with rights as other human beings and full-value members of society. Because of their age, state of physical and mental development and incompetence to defend their own interests themselves they deserve special care and protection. Children’s position in family and society seems to be determinant for their legal status the most. This position had changed a lot during the centuries and is quite different in comparison with the status of children in ancient times. Historians bring very interesting conclusion to the light that the phenomenon of childhood did not exist up the 18th century at all. Children were considered as small adults. Adults didn’t treat children differently from themselves. Situation changed with the emphasizing the importance education has. Education put stress on the difference between the level of knowledge children and adults have and created the special category of childhood. Long time have passed since the first legal acts concerning children’s rights were enacted. Their main aim was to protect children against poverty, war and cruelty and to provide them conditions for happy and safe life. The strategy of the Convention on the Rights of the Child was different. Convention on the Rights of the Child focused its attention on declaring the child as an active subject of his rights. Hypothesis of this disertation works with the statement that despite of this fact the objectivization of the child is still present. It can be found in conducts and thoughts of parents, in practice of state institutions or in the constuction of few provisions in legal acts. My premise is apparent on the problem of protection of unborn chilren the most. Cases of surrogate mothers, of parents willing to choose the sex or other characteristic of their children could serve as an example here. The value of embryo is being put in the conflict with an importance a research performed on embryos may have for curing serious diseases. It’s not a subject of rights anymore, his value does not become equal to the future prospect research may bring. That is why my disertation shall come to the conclusion that no matter how numerous the legislation protecting children’s rights will be, the concept of children’s rights protection can not rest only on this field itself. Thinking about the issue of children’s rights and the practical application of their claims must be governed with the idea of children as active subjects of their rights no matter what interests of any other person are.
