Abstract:

Závěrečná bakalářská práce se zabývá dohledem probačního úředníka a probačním programem. Tato služba se vztahuje částečně i k vědnímu oboru andagogiky, která se zabývá vedením a vzděláváním jedinců, ovšem činnost Probační a mediační služby je vedena spíše v duchu resocializace a pomoci začlenění deviantního jedince zpátky do společnosti. Cílem práce bylo popsat jak funguje činnost Probační a mediační služby, vymezit a částečně i analyzovat současný resocializační systém probace a vymezit pozitivní či negativní jevy, které se v této oblasti vyskytují. Závěrečná bakalářská práce je rozdělena na dvě části. První část se zabývá vymezením co to je Probační a mediační služba, její význam a činnost. Druhá část popisuje konkrétní činnost probačního úředníka a možnosti probačních programů. Předkládaná práce už ve svém názvu tématu naznačuje, že se jedná o studii, kdy jsem se pokusil charakterizovat význam a vývoj určitých úseků v práci Probační a mediační služby České republiky. Tak, jak probíhaly změny ve společnosti, měnil se charakter a poslání mocenských složek. Již od samého počátku byla práce jak bezpečnostních složek tak složek spravedlnosti státního aparátu natolik specifická, že vykonávat službu ve státním úřadě mohli a můžou jen jedinci, kteří jsou schopni vyhovět náročným požadavkům. Jak se tyto změny promítly do práce se společensky deviantními jedinci jsem se pokusi naznačit v dalších částech této práce. Jsem si vědom toho, že tuto práci není možno chápat jako úplný výčet všech forem působení. Mojí snahou při zpracování tématu, bylo poskytnout ucelenou informaci v dané problematice, se zaměřením na mladistvé prvopachatele. Ve své práci se snažím o studium a analýzu současného systému působení Probační a mediační služby České republiky (tj. zejména studiem písemných interních zdrojů vztahujících se k danému tématu a studiem související literatury). Informace k dané problematice diplomové práce lze v současnosti čerpat z poměrně širokého spektra odborné literatury zabývající se působením a spolupráci se společensky deviantními jedinci. Období počátků budování probace a mediace v Čechách se váže k usnesení vlády č. 341/1994 v rámci programu Prevence kriminality, kterým vláda uložila ministru spravedlnosti, aby zřídil místa probačních úředníků v souvislosti s již přijatými i připravovanými instituty alternativních opatření a trestů. Od 1. 1. 1996 bylo toto usnesení zrealizováno a na většině okresních a několika krajských soudech byla zřízena místa probačních úředníků. Plněním úkolů spojených s probačními činnostmi byli většinou pověřeni pracovníci odborného aparátu soudů a vyšší soudní úředníci, kteří se zaměřovali zejména na zajištění administrativně technického výkonu trestu obecně prospěšných prací a na formální kontrolu chování pachatelů v rámci trestů spojených s uložením zkušební doby s dohledem nebo přiměřenými povinnostmi a omezeními. Probační a mediační služba je součásti systému trestní justice, která vznikla schválením zákona č. 257/2000 Sb. Představuje novou instituci, která se zaměřuje na zprostředkování alternativních způsobů řešení trestné činnosti. Snaží se motivovat pachatele trestných činů k odpovědnosti za jejich jednání a řešení způsobených škod. Zohledňuje zájmy obětí trestné činnosti a nabízí jim možnosti a informace, jak se zapojit do řešení škod, které jim vznikly při trestné činnosti. žalovaným nebo odsouzeným, kontrola trestů nespojených s odnětím svobody, včetně uložených povinnosti a omezení, sledování chování odsouzeného ve zkušební době podmíněného propuštění výkonu trestu odnětí svobody, dále individuální pomoc obviněnému a působení na něj, aby vedl řádný život, vyhověl soudem nebo státním zástupcem uloženým podmínkám, a tím došlo k obnově narušených právních i společenských vztahů.

Abstract:

This final Bachelor Thesis addresses the questions of probation officer surveillance and the probation program. This service also partially regards andragogy, science discipline concerning the leading and education of individuals; however, the Probation and Mediation Service activities are executed rather in the sense of re-socialization and help with the re-integration of the deviant individual back into society. The aim of the thesis was to describe the activity of the Probation and Mediation Service, define and partially analyze the actual re-socialization system of probation, and define both the positive and negative features interconnected with this area. This final Bachelor Thesis is divided into two parts. The first one addresses the definition of probation and mediation service, its sense, and activities. The second one describes the actual work of the probation officer and probation program possibilities. The submitted thesis implies in its title that it is a study in which I tried to characterize the importance and development of certain parts of the work of the Probation and Mediation Service of the Czech Republic. The character and mission of the security forces also changed in line with the development of changes in society. As of the very beginning, the level of specificity of the work of both security authorities and justice authorities used to be so high, that only individuals being able to pass very demanding requirements could act in the government agency. I tried to indicate the way in which these changes were projected into the work with socially deviant individuals in the other parts of this thesis. I am aware of the fact that it is not possible to consider this thesis a complete list of all kinds of influence. By elaborating this thesis, my endeavor was to provide complex information regarding the respective issue, with focus on teenager first-offenders. In my thesis I try to study and analyze the actual system of influence of the Probation and Mediation Service of the Czech Republic (by studying documentary internal sources regarding the respective theme and studying the connected literature, in particular). Nowadays, it is possible to gather the information regarding the theme of the thesis from a rather broad range of professional literature regarding the activity and cooperation with socially deviant individuals. The starting period of the founding of probation and mediation in the Czech Republic is connected with Government Decree No. 341/1994 within the Crime Prevention Program, by which the government imposed Minister of Justice to create the positions of probation clerks in connection with both already approved as well as prepared institutions of alternative measures and sentences. This Decree was fulfilled as of January 1st, 2006, and positions of probation clerks were created in the majority of districts and several regional courts. The employees of professional apparatuses of courts and higher court clerks concentrating on the assurance of the administrative-technical execution of sentences of community services and formal control of offenders’ behavior during the execution of sentences connected with an imposed probation period with surveillance or adequate obligations and limitations, in particular, were entrusted with fulfilling the tasks interconnected with probation activities. The Probation and Mediation Service, forming a part of the criminal justice system, was founded by the passing of Act No. 257/2000 Coll. It represents a new institution focusing on mediation of alternative means of solution of criminal activity It tries to motivate criminals to bear the responsibility for their acts and find solutions of damages caused. Probation means organization and execution of surveillance over the accused, defendant, or sentenced, control of penalties not connected with imprisonment including imposed obligations and limitations, observation of the behavior of the convicted during the probation of imprisonment parole, furthermore, individual help to the accused and influencing him to lead an orderly life, satisfy conditions set by the court or by the public prosecutor, and, subsequently, to re-establish legal and social relationships in this way.
