The Issue of Avoiding Double Taxation for Natural Persons

Abstract:

Cílem diplomové práce je zhodnocení dopadů mezinárodního zdanění zahraničních příjmů českých rezidentů v podobě fyzických osob, a to jak příjmů aktivních, tak i příjmů pasivních. K tomuto zhodnocení je využit v teoretické části jednak rozbor stávající právní regulace v předmětné oblasti, a to včetně způsobů zamezení dvojímu zdanění, dále je využita komparace a analýza pramenů práva v této oblasti. Z vědeckých metod v teoretické části je využita zejména deskripce k terminologii a k vymezení problematiky, a dále analýza, analogie a syntéza ke zhodnocení současného právního stavu. V praktické části jsou modelovány tři reálné situace mezinárodního zdanění vybraných aktivních a pasivních zahraničních příjmů českých rezidentů v podobě fyzických osob, když příjmy pocházejí z oblíbených zahraničních destinací, a to konkrétně ze Spojených států amerických, dále ze Spojeného království Velké Británie a Severního Irska, a nakonec ze Spolkové republiky Německo, přičemž dané modelové situace reálně zobrazují práva a povinnosti daňového subjektu.

Abstract:

The aim of the thesis is to evaluate the impact of international taxation of foreign income of Czech residents in the form of natural persons, both active income and passive income. For this evaluation, an analysis of the existing legal regulation in the subject area is used in the theoretical part, including ways to avoid double taxation, and a comparison and analysis of the sources of law in this area is also used. Of the scientific methods in the theoretical part, the description of terminology and the definition of the issue is used, as well as analysis, analogy and synthesis to evaluate the current legal situation. In the practical part, three real situations of international taxation of selected active and passive foreign income of Czech residents in the form of natural persons are modeled, when the income comes from popular foreign destinations, specifically from the United States of America, then from the United Kingdom of Great Britain and Northern Ireland, and finally from the Federal Republic of Germany, while the given model situations realistically depict the rights and obligations of the tax subject.
