Bankruptcy, insolvency and liquidation of a company

Abstract:

Diplomová práce je zaměřena na stále aktuální témata - insolvence, krize ve firmě, úpadek a její likvidace. Práce je členěna do dvou částí. První z nich je věnována vymezení základních pojmů z oblasti insolvence, krize ve firmě, úpadek firmy a možnosti jeho řešení a likvidace firm. Druhá část je věnována společnosti Metall Group, a.s., jejím organizačním, finančním a obchodním problémům, které byly z velké části způsobeny útoky ze strany bývalých členů představenstva společnosti a osob s nimi spolčených, nesoučinností obchodního rejstříku a přicházející finanční krizí. Dále pak práce obsahuje průběh řešení úpadku této firmy, navrhované možnosti na její záchranu a popis průběhu insolvenčního řízení společnosti Metall Group, a.s. Závěr práce obsahuje shrnutí výše uvedeného a také vyhodnocení zda by některá z navrhovaných variant pro záchranu firmy byla reálná či nikoliv.

Abstract:

Diploma thesis is focused on currently high topical issues – insolvency, crisis in the company, bankruptcy and liquidation of a company. The work is structured into two parts. The first is about basic terms from the sphere of insolvency, crisis in companies, bankruptcy of company, liquidation and methods of liquidation. The second part is concerned with company Metall Group, Inc., its organizational, financial and commercial problems which were mainly determined by attacks by former board members and people associated with them, lack of cooperation of the Commercial Register and coming financial crisis. The thesis describes the process of resolving insolvency of the company and a proposed options from rescue the company. The conclusion contains a summary of the above, and also to assess whether any of the proposed options for saving the company was real or not.
