Correction of the Convicted Persons During Their Imprisonment

Abstract:

Tato rigorózní práce si klade za cíl představit rozličné programy zacházení a další resocializační programy, které přispívají k nápravě odsouzených a které jsou realizovány v českých věznicích u dospělých odsouzených v rámci výkonu trestu odnětí svobody. Pozornost proto bude věnována jak obecným východiskům problematiky trestání a jeho účelu, tématu výkonu trestu odnětí svobody, tak specifickým aspektům této problematiky. Zohledněny tudíž budou i poznatky z dalších vědních odvětví, jako jsou penologie, penitenciaristika, kriminologie či forenzní psychologie. Důraz bude kladen především na penologické aspekty zmiňovaných programů zacházení a na možnost reintegrace odsouzených do společnosti po propuštění z výkonu trestu odnětí svobody. Pozornosti neuniknou ani Vězeňská služba ČR a Probační a mediační služba ČR a jejich role v procesu nápravy odsouzených. Práce tak nabídne přehled a kritické zhodnocení stávající relevantní právní úpravy i praxe a v samotném závěru také úvahy de lege ferenda. Okrajově bude rovněž přiblížena problematika stigmatizace odsouzených, resp. již propuštěných osob, prostřednictvím jejich mediálního obrazu.

Abstract:

This rigorous work aims to present various treatment programs and other resocialization programs that contribute to the correction of convicted persons, and which are implemented in Czech prisons for adult offenders serving a prison sentence. The attention will therefore be paid to both the general starting points of the issue of punishment and its purpose, the topic of serving a sentence of imprisonment, and specific aspects of this issue. The relevant knowledge from other scientific fields, such as penology, penitentiary studies, criminology, or forensic psychology, will therefore also be taken into account. Emphasis will be placed primarily on the penological aspects of the mentioned treatment programs and on the possibility of reintegration of the convicted persons into society after release from imprisonment. The Prison Service of the Czech Republic and the Probation and Mediation Service of the Czech Republic and their role in the process of correction of the convicted persons will not escape the attention either. This work will thus offer an overview and critical evaluation of the existing relevant legislation and practice, and in the very conclusion, also de lege ferenda considerations. The issue of stigmatization of the convicted persons, or already released persons, through their media image will also be briefly mentioned.
