Compare and analysis of selecting procurer by subvene receiver with regard to the Public Procurement Act

Abstract:

Bakalářská práce se zabývá porovnáním podmínek vynakládání veřejných prostředků u dotačních titulů (veřejných prostředků poskytnutých na realizaci akce pod určitým dotačním titulem) a podmínek vynakládání veřejných prostředků s ohledem na zákon o veřejných zakázkách, včetně uvedení míry transparentnosti a efektivnosti uvedených pravidel. První část práce je zaměřena na popis a strukturu veřejných výdajů, včetně členění národního hospodářství podle principu financování. Druhá část práce se zabývá stručnou analýzou zákona č. 137/2006 Sb., o veřejných zakázkách. Třetí část práce seznamuje čtenáře se Strukturálními fondy EU a závěr práce uvádí konkrétní pravidla a požadavky pro financování veřejných zakázek prostřednictvím dotačních titulů s ohledem na zákon č. 137/2006 Sb., o veřejných zakázkách.

Abstract:

This Bachelor thesis presents a comparison of the conditions of public funds spending that is based on subsidy entitlements (public funds awarded for a realization of an enterprise, under a specific subsidy entitlement) and the conditions of public funds spending with regard to the Public Contracts Act. The transparency and effectiveness of the aforesaid regulations is examined. The first part of the thesis comprises a description of the public funding structure and of the national economy structuring with regard to financing. In the second part a concise analysis of the Public Contracts Act No 137/2006 of the Collection is given. The third part presents a survey of the EU Structural Funds. As a conclusion, particular rules and requirements for the public contracts financing by means of subsidy entitlements with regard to the Act No 137/2006 of the Coll. are proposed.
