Parole from prison

Abstract:

Cílem mé práce je podat ucelený přehled o institutu podmíněného propuštění, jak po stránce hmotně právní, tak po stránce procesně právní. Zaměřuji se na popis jednotlivých podmínek, které je nutné splnit, pokud chce odsouzený dosáhnout podmíněného propuštění. Tyto podmínky se snažím posoudit v souvislostech, vložit do jejich rozboru své zkušenosti a porovnat je s aplikací současné (byť ne příliš hojné) judikatury. K předmětné problematice prozatím neexistuje ucelené zpracování v odborné literatuře. Práce si neklade za cíl tuto absenci nahradit. Jejím účelem (a snad i přínosem) je poskytnout komplexní pohled na vybrané téma v širších souvislostech, případně podnítit diskuzi k tomuto tématu. Fakticky je práce rozdělena do sedmi základních kapitol. Po poněkud odlehčeném úvodu se v druhé kapitole věnuji poněkud teoretickým otázkám pojmu a účelu trestu. Zabývám se v ní nejen definicí či vymezením těchto pojmů, ale věnuji se (byť nikoli vyčerpávajícím způsobem) jednotlivým teoriím trestu, účelu trestu, funkcím trestu a v neposlední řádě systému trestu. Nesnažím se v této kapitole o vyčerpávající analýzu, v tomto směru jsou zde práce jiné , jde mi pouze o uvedení stěžejní problematiky této práce a to nejen z právního pohledu, ale tak trochu i z pohledu filozofického, jelikož účel trestu tak trošku filozofická otázka je. Kapitola třetí již uvádí nosné téma této práce, a to prostřednictvím historického exkurzu k institutu podmíněného propuštění v ČR (byť se nejedná o historii nijak dlouhou) a je možné institut podmíněného propuštění označit jako institut mladý, který se zrodil teprve v minulém století. Po historickém exkurzu práce zpracovává zásadní téma - podmíněné propuštění. Nejprve v kapitole čtvrté jeho hmotně právní podstatu, v kapitole páté poté procesně právní podstatu. Pokud jde o kapitolu čtvrtou, věnuji se v ní především naplnění podmínek, které jsou nutné pro podmíněné propuštění. A to jednak podmínek obligatorních, jednak podmínek fakultativních. V procesní části kapitoly páté se poté věnuji aspektům spojeným s řízením o podmíněném propuštění, včetně podnětů a slabých míst právní úpravy, tak jak jsem je pochytil během své praxe. Stručný přehled vybraných zahraničních úprav obsahuje kapitola sedmá, jedná se především o právní úpravy našich sousedů (Slovenska, Německa, Polska), ale i dalších států s inspirativním právním řádem (Francie, Rusko), případně tak trošku pohrobkem (alespoň co do právní úpravy trestního práva, práva socialistického, tedy Bulharska). Předmětné právní úpravy mi pak umožnily, v souladu s mými zkušenostmi a teoretickými poznatky (včetně judikatury) dospět k možným námětům „de lege ferenda“ na úpravu institutu podmíněného propuštění v naší právní úpravě. Jimi se zabývám, včetně svých závěrů, v kapitole sedmé.

Abstract:

Aim of my thesis is provide a comprehensive overview of the Institute of parole on both the substantive law and in terms of procedural law I focus on describing the various conditions that must be met if the prisoner wants to achieve parole.These conditions are considered in the context of trying, put it in thein analysis of my experiences and compare them with the application of the prezent case, law not much .The issue in question is not there yetcomprehensively in the legal literature The thesis does not aim to replace this absence, and purpose is to provide a benefit at this point a comprehensive view of selected topics in a broader context, and possibly to stimulace discussion on this topic. The thesis is dividend into seven chapters. After a somewhat light-heartedintroduction to the sekond chapter deals with theoretical questions of the koncept and purpose of punishment I deal in this chapter not only definitions of these terms, but I deal with, though not exhaustively, individual theories of punishment, the purpose of punishment, functions of punishment, and, finally, a system of punishment. I'm not trying in this chapter is an exhaustive analysisin this direction are other thesis. I just want to state the core problem of this thesis, not only from a legal perspective, but also a bit of a philosophical perspective, since the purpose of punishment and a bit of a philosophical question. Chapter Three provides already the main topic of this thesis through a historical excursion to the institute parole in the Czech Republic, although there is no way a long history, and the parole may be described as a young institute, which was born only in the last century. After a historical excursion thesis processes an essentials topic and it is parole, first in chapter four, the substantive legal nature, then the fifth chapter procedural nature parole. As the fourth chapter is devoted promařily the achievement of conditions that are necessary for conditional release. First, it's mandatáry requirements, which include time for parole, if properly imprisonment, and adecent life, for leadership. First, this chapter deals with the optional conditions, so early arrival in prison, pay compensation, atonement, or other damane or other injury. In the process law of the fifth chapter is then devoted to issues connected with the proceedings for parole, including incentivesand regulatory weaknesses, as I picked up dutiny their praktice. A brie overview of selected international arrangements include the seventh chapter, it is mainly the regulation of our neighbors(Slovakia, Germany, Poland), but also inspiring other states with the law (France, Russia), where the Bulgarien legislation, which still contains some elements Socialist criminal law. The relevant legislation to enable it to me in accordance with my experience and theoretical knowledge, including case law to arrive at possible themis „de lege ferenda" adjustment of conditional release in our legislation, which deals with, including his conclusions in chapter seven.
