Selected aspects of media effects on criminal justice system and judicial decision making process

Abstract:

Rostoucí zájem médií o trestněprávní problematiku, a především pak samotný soudní proces, s sebou přináší celou řadu nových jevů řešených na pomezí mediální a právní teorie. S vědomím rozsáhlého záběru materie se předkládaná diplomová práce orientuje na vybrané aspekty působení médií na trestní soudnictví a proces soudního rozhodování. V návaznosti na teorii sociální konstrukce reality, respektive mediální konstrukce reality trestné činnosti a kriminality tuto porovnává se zkušenostní realitou českých soudců trestních případů. Cílem studie je na podkladě polostrukturovaných rozhovorů identifikovat vnímané rozdíly mezi běžnou praxí respondentů a jejím odrazem v médiích. Teoretické pasáže textu blíže rozvíjí aktuální pohled na prezentaci trestné činnosti ve sdělovacích prostředcích, možnosti ovlivnění soudního procesu, jakož i vytváření obrazu justice v očích veřejnosti. Práce mimo jiné navazuje na již realizované zahraniční výzkumy, snaží se o jejich ověření v českém prostředí, a zároveň směřuje k nalezení dosud nezvažovaných možností působení médií v rozhodovací činnosti justice v souladu s výzkumným designem zakotvené teorie.

Abstract:

Increasing media interest in criminal issues, primarily in the judicial process itself, brings a series of phenomena that are discussed within the interface of media and legal theory. With the extensive scope of this topic in mind, the thesis focuses mainly on selected aspects of media impact on criminal justice and judicial decision-making process. Following the theory of social constructionism of reality, or more precisely the theory of media constructionism the author provides a comparison between the experienced reality of Czech criminal judges and media constructed reality in terms of crime and criminal activity. On the bases of semi-structured interviews the aim of the study lies in identification of perceived differences among prevalent practice of the respondents and its reflection in the media world. In the beginning theoretical passages further develop the current view of the presentation of crime and justice in media, while also explore the possibility of media influence in judicial process as well as the idea of distorted image of justice in the eyes of public. Apart from the themes specified above presented thesis consequently uses existed research work while still tending to discover another options of media effects in the justice decision-making process in accordance with the research design of grounded theory.
