Abstract:

Místní poplatky jsou obcemi zaváděny v rámci samostatné působnosti a po jejich zavedení obecně závaznou vyhláškou se stávají pro poplatkové subjekty povinnou platbou. Se správou místních poplatků souvisí řada problémů, které se liší nejen velikostí obcí a jimi zavedenými místními poplatky, ale také platební morálkou jejich občanů v roli poplatkových subjektů. Cílem je určit slabá místa a nejasnosti některých ustanovení, která působí obcím při správě místních poplatků nadále závažné problémy. Správa místních poplatků je v současné právní úpravě zahrnuta jen v několika ustanoveních zákona o místních poplatcích. Daňový řád je vyhovující spíše pro správu daní spravovanou finančními orgány než pro správu místních poplatků. Pro správu místních poplatků jsou postupy podle daňového řádu příliš složité a administrativně náročné a pro malé obce obtížně využitelné.

Abstract:

The local fees are introduced by the municipalities within their autonomous competence and after their introduction by the means of a generally binding decree, the local fees become a mandatory payment for the fee payers. There is a number of problems related to the management of the local fees which differ not only in terms of the size of the municipalities and the local fees introduced by them but also in terms of the payment history of their citizens in the role of the fee-payers. The objective is to determine weaknesses and ambiguities of certain provisions which have been causing significant problems to the municipalities in relation to the management of the local fees. The management of the local fees is included in the current system of law only in a few provisions of the Act on Local Fees. The Tax Procedure Code is more suitable for the management of taxes performed by revenue authorities than for the management of the local fees. The procedures according to the Tax Procedure Code are too complex and demanding for the management of the local fees in terms of paper work and they are hardly usable by small municipalities.
