Error correction in the land register

Abstract:

Cílem této bakalářské práce je popsat právní režim opravy chyb v katastru nemovitostí. Po krátké historické exkursi k dané problematice, je zaměřena pozornost na aktuální problémy jednotlivých chyb v katastrálním operátu v návaznosti na platné právní úpravy účinné od 1.1.2014. Podrobněji je rozvedeno téma k chybám v geometrickém a polohovém určení hranic pozemku vzniklých jak zřejmým omylem, tak nepřesností při podrobném měření a zobrazení předmětu měření v katastrální mapě a dále také chybám v evidované výměře pozemků. Bakalářská práce je doplněna vhodnými příklady a poznatky z aplikační praxe, na základě získaných zkušeností při výkonu zeměměřických činností. Poslední část je zaměřena na procesní hledisko při opravě chyb, řádné a mimořádné opravné prostředky a případný soudní přezkum.

Abstract:

The aim of this barchelor thesis is to describe the legal status of error correction in the cadastre. After a short historical overview on this issue, the attention is focused on current problems of individual errors in the cadastral survey in connection with the valid legislation active from January 1, 2014 . The theme is elaborated in detail for errors in the geometric and positional determination border plots of land as an obvious error and inaccuracy in the measurement and display of the measurement object in the cadastral map and also to errors in the registered area of land. The thesis is accompanied by appropriate examples and lessons of its application, based on experience gained in the performance of surveying activities . The last part is focused on the procedural aspect of the repair errors ordinary and extraordinary remedies and possible judicial review.
