Discrimination in Labour Law

Abstract:

Téma diskriminace v pracovním právu zasahuje do mnoha oblastí a může být posuzováno z různých pohledů. Bakalářská práce je členěna do pěti částí, které na sebe v posloupnosti navazují. První část je věnována objasnění pojmu diskriminace a obecně teoretickému výkladu právních norem, které upravují problematiku diskriminace a rovných příležitostí. Druhá část je pokusem o historický exkurz s náznakem hlavních příčin přetrvávající nerovnosti na trhu práce a možností zlepšení při zavedení flexibilních forem zaměstnávání. Porušení rovných příležitostí v přístupu k zaměstnání a v pracovním poměru jsou obsahem třetí části společně s uvedením praktických příkladů. Čtvrtá část podrobně popisuje možnosti obrany proti nežádoucímu chování. V závěru práce jsou uvedeny výsledky vlastního šetření v této oblasti v souvislosti s praktickou zkušeností a navrženy možnosti opatření vedoucí ke zlepšení postavení žen na trhu práce.

Abstract:

Discrimination in labour law affects many areas and can be assessed from different perspectives. The thesis is divided into five parts to each other in the sequence follow. The first part is devoted to clarifying the concept of discrimination in general and theoretical interpretation of legal norms that govern the issue of discrimination and equal opportunities. The second part is an attempt at a historical excursion with a hint of the main causes of persistent inequality in the labour market and improvements in the introduction of flexible forms of employment. The third part is focused on the violation of equal opportunities in access to employment including practical examples. The fourth section describes the possibility of defense against adverse behaviour. Finally there are the results of own investigations in this area in connection with practical experience and policy options designed to improve the status of women in the labour market.
