The Phenomenon of (Im)migration and Immigration Policy of the European Union

Abstract:

Primárním cílem prezentované disertační práci byla deskripce specifik imigrační problematiky a interpretace významu imigrační politiky v kontextu evropské integrace. Sekundárním cílem disertační práce bylo verifikovat či vyvrátit hypotézu, zda postupný přesun imigrační politiky na supranacionální úroveň může přinést její pozitivní racionalizaci, případně reformulaci cílů, neboť národní liberální státy Evropské unie již zřejmě nejsou schopny problémy spojené s migrací vyřešit unilaterálně. Jinými slovy, zda tento senzitivní přesun kompetencí napomůže překonat rozpor mezi požadavky veřejného mínění (a tedy voličů, kteří primárně konceptualizují migraci jako problém a hrozbu) většiny zemí Evropské unie na aplikaci restriktivní imigrační politiky na straně jedné a reálnou demografickou (stárnutí populace) a ekonomickou (poptávka pracovního trhu po migrantech) situací národních liberálních států, které jsou navíc konfrontovány se stále sílícími transnacionálními a globalizačními procesy, na straně druhé. Normativním východiskem disertační práce je transnacionalismus, zejména ve vymezujícím se pojetí vůči metodologickému nacionalismu. Disertační práce je strukturována do dvou částí. Úvodní část poskytuje spíše obecné, ovšem z hlediska aspirací a cílů disertační práce kontextuální informace, které jsou následně využívány v části následující, zaměřené zejména na imigrační politiku v Evropské unii. Po nezbytném nástinu problematiky se tak v prvé části postupně věnuji problematice konceptualizace migrace, limitům migračního výzkumu, liberálnímu paradoxu omezujícímu regulaci migrace v národních liberálních státech a vztahu mezi migrací a rozvojem. Druhá část je již zaměřena konkrétně na genezi evropské imigrační (a azylové) politiky, její dominantní aktéry a výstupy. V závěru pak nejprve konstatuji, že relativně rychle se rozvíjející integrační proces v oblasti azylu a migrace nemusí nutně vést k faktickému posilování supranacionálních mechanismů a institucí Evropské unie. Naopak pravděpodobnější je spíše restriktivní forma mezivládní kooperace. V kontextu nastolené hypotézy pak dále shrnuji příčiny, proč stávající specificky technokratická forma evropské imigrační (a azylové) politiky realizovaná prostřednictvím soupeření mezi dominující transgovermentální sítí centralizované kolem Rady Evropské unie (zahrnující bezpečnostní experty a elitní zástupce členských zemí) a opoziční supranacionální aliancí (složené z Evropské komise, nevládních organizací a částečně dalších aktérů) k překonání výše formulovaného rozporu pravděpodobně nepovede. Zároveň dodávám, že řešení problému by mohla přinést pouze široká kooperace všech relevantních aktérů s cílem depolitizovat a rekonceptualizovat (i)migrační diskurs prostřednictvím legitimní veřejné debaty, která však zřejmě není vzhledem k heterogenitě zájmů aktérů i vysoké senzitivitě imigrace, v krátkodobé perspektivě reálná.

Abstract:

The primary objective of the presented dissertation was to describe the specifics on the problematic of immigration and to interpret the meaning of the immigration policy within the context of the European integration. The secondary objective of the dissertation was to confirm or reject the hypothesis of whether the gradual shift in immigration policy to a supranational level may bring its positive rationalization or reformulation of objectives, because national liberal states of the European Union are already apparently incapable of unilaterally resolving problems with migration. In other words, I examine whether this sensitive shift of competencies helps to overcome the disharmony between the demands of public opinion (and thus voters who primarily conceptualize migration as a problem and a threat) of the majority of European Union Member States for implementation of a restrictive immigration policy on one hand, and on the other hand the realistic demographic (aging population) and economic (job market demand for migrant workers) situation of national liberal states, which are moreover confronted with ever-strengthening transnational and globalization processes. The normative starting point of this dissertation is transnationalism, mainly in a defining conception towards methodological nationalism. The dissertation is structured into two parts. The introductory part provides more general, of course contextual information in terms of the aspirations and objectives of the dissertation, mainly focusing on the immigration policy in the European Union. After essential outlining of the problematic, in the first part I gradually discuss the conceptualization of migration, the limits of migration research, the liberal paradox limiting regulation of migration in national liberal states, and the relationship between migration and development. The second part focuses specifically on the genesis of European immigration (and asylum) policy, its dominant actors and outputs. In conclusion, I first state that the relatively fast-developing integration process in the area of asylum and migration needn’t necessarily lead to factual strengthening of supranational mechanisms and institutions of the European Union. On the contrary, a restrictive form of intergovernmental cooperation is more probable. Within the context of the presented hypothesis, I further summarize the causes of why the existing specifically technocratic form of European immigration (and asylum) policy implemented in specific cases by means of competition between a dominating transgovernmental net centralized around Council of the European Union. (including security experts and elite representatives of Member Countries) and the opposition supranational coalition (comprised of the European Commission, non-governmental organizations and in part other actors) towards overcoming the aforementioned formulated disharmony will probably not be successful. I add that resolving the problem could only come through wider cooperation of all relevant actors with the objective of depoliticizing and reconceptualizing (im)migration discourse by means of a legitimate public debate, which of course is apparently not realistic in the short time in regards to the heterogeneous interests of actors and high sensitivity to immigration.
