Criminal Offences In Traffic and Principle of Limited Trust

Abstract:

Záměrem práce zabývající se trestnými činy v dopravě, především dopravními nehodami, bylo věnovat se problematice dopravy z pohledu trestního práva a kriminalistiky. Na začátku se proto zabývá samotným pojmem dopravy, trestných činů v dopravě a dopravních nehod z těchto dvou pohledů a následně rozebírá příčiny dopravních nehod, z nichž největší pozornost věnuje lidskému faktoru. V samostatné kapitole pak rozebírá návykové látky jako příčinu dopravních nehod, jejich vliv na účastníky provozu a jejich detekci, což se ukazuje jako stále závažný nešvar a problém na našich silnicích. Popisuje také rozdíl mezi jednáním pod vlivem návykové látky zakládající přestupek a zakládající trestný čin a situaci, kterou z medicínského pohledu nelze považovat za ovlivnění člověka. Dále se práce jako jedné z nejobsáhlejších částí věnuje charakteristice trestných činů spojených s dopravou, které rozděluje po vzoru trestního zákoníku. Zde už se netýká pouze dopravních nehod, ale i další trestné činnosti spojené s dopravou, včetně majetkové, a v další kapitole se pak už soustředí na další stěžejní část, subjekt a subjektivní stránku trestných činů, tedy pachatele a spolupachatele a zavinění. Rozebírá proto spoluzavinění při dopravních nehodách, které se vzhledem ke zmíněným definicím dopravních nehod stává většinou ve formě zdánlivého spolupachatelství, a princip omezené důvěry. Ten je jedním z nejdůležitějších principů při objasňování trestných činů v dopravě a významně zasahuje do vztahu pachatele a poškozeného. Práci pak uzavírají některá specifika dokazování při objasňování trestných činů v dopravě, a to v přípravném řízení i řízení před soudem, a krátká zmínka o specifických důkazních prostředcích.

Abstract:

The intention of this thesis dealing with criminal offenses in traffic, especially traffic accidents, was paid attention to the issue of traffic from the perspective of criminal law and criminology. Therefore it deals with the very concept of traffic, traffic offenses and accidens from these two perespectives at the beginning and then analyzes the causes of accidents, of which pays the greatest attention to the human factor. Thesis then discusses addictive substances as a cause of accidents, their impact on traffic users and their detection, which is proving to be increasingly serious nuisance and a problem on our roads. It also describes the difference between acting under the influence of drugs and founding minor offense and crime and a situation that from a medical point of view can not be regarded as affecting. Next the thesis describes as one of the most comprehensive part the characteristics of crimes related to transport, which splits along the divisions of the Criminal Code. Here it is not only about traffic accidents, but as well as other criminal activities related to traffic, including property crimes, and in the next chapter then focuses on another key part, the subject and the subjective aspect of crimes, ie offender and accomplices and fault. Therefore it analyzes a contributory fault in traffic accidents that owing to the mentioned definitions accidents usually happens in the form of unreal complicity, and the principle of limited trust. It is one of the most important principles in clarification of criminal offenses in traffic and significantly intevenes in the relationship of the offender and the victim. Thesis then conclude some specific evidence in clarification of criminal offenses in traffic, and that in the pre-trial and court procedures, and a brief mention of specific means of evidence.
