Abstract:

Diplomová práce zahrnuje otázky, týkající se pěstounské péče, která je náhrádní rodinou péči. Vysvětluje pojem pěstounská péče, její vznik a zánik. Dále vysvětluje pojem rodičovská zodpovědnost a pojem pěstoun. V souvislosti s pěstounem vymezuje jeho práva a povinnosti vůči svěřenému dítěti. Pojednává o procesní stránce pěstounské péče, která je důležitou součástí diplomové práce. Další část práce souvisí s hmotně-právním zabezpečením dítěte společně s vyživovací povinností. V práci se dále zmiňují jednotlivé typy pěstounské péče. Dochází k srovnání s ostatními isntituty náhradní rodinné výchovy, včetně ústavní péče. Závěr práce se týká připravované rekodifikace občanského zákoníku, který by měl pěstounskou péči upravovat. Poslední částí práce je právní úprava pěstounské péče v Ruské Federaci.

Abstract:

The diploma thesis concentrates on problems of foster care, which is one of the alternatives of family care and education. It explains the concept of foster care, her origin and doom. It explain too the concept of family responsibility and concept of fosterer. In context of the fosterer it limits their rights and duty. The thesis deals about procedural page of foster care, which is the necessary component of the diploma thesis. Next part of the thesis relates to a material comforts of the child, together with the duty of alimony. The thesis also mentions the institutional care and education and other types of collective education, the different types of foster care, mainly the foster care for temrporary period of time and the pre- foster care. In the end it treatsabout the recodification of the Code of civil law, which is being prepared the thesis also mentions this reform. The last part of the thesis is devoted to a comparaison between the foster care in the Czech Republic and in the Russian federation.
