Consumer contracts in the Czech and Russian law

Abstract:

Bakalářská práce se zabývá právní úpravou spotřebitelských smluv v České republice a Ruské federaci. Cílem práce je porovnání české a ruské legislativy v oblasti spotřebitelských smluv, stanovení nejdůležitějších shod a odlišností, posouzení sporných momentů a nakonec zaujetí osobního stanoviska ke zkoumané problematice. V práci byla použita metoda komparace a metoda kritické analýzy. Kromě toho byla uplatněna vlastní interpretace právních norem, neboli gramatická metoda. V první části jsou popsány jednotlivé pojmy týkající se spotřebitelských smluv a jejich náležitosti v obou zemích, jsou rozebrány pojmy: distanční smlouva, smlouva mimo obchodní prostory, smlouva o finančních službách a tzv. timesharingové smlouvy každé země zvlášť. Druhá část je věnována podstatě ochrany spotřebitele a také její komparaci mezi oběma zeměmi. Poslední část zahrnuje porovnání právních úprav spotřebitelských smluv České republiky a Ruské federace. Výsledkem práce bylo nalezení shod i odlišností mezi právními úpravami obou zemí. Hlavním zjištěním bylo zejména to, že ruská legislativa je v porovnání s českou velmi zaostává v oblasti spotřebitelských smluv. Jako shrnutí dané problematiky autorka bakalářské práce nabízí doporučení „de lege ferenda“.

Abstract:

Bachelor thesis deals with the legal regulation of consumer contracts in the Czech Republic and the Russian Federation. The aim of the thesis is to compare Czech and Russian legislation in the context of consumer contracts, to determine the most important similarities and differences, to assess the contentious moments and, finally, to take a personal opinion on the researched issue. The author used the method of comparison and the method of critical analysis. In addition, its own interpretation of legal norms, in other words grammatical method, was applied. The first part describes the individual concepts related to consumer contracts and their requirements in both countries. The concepts are discussed such as: distance contract, contract concluded away from business premises, financial services contract, and timeshare contract of each country separately. The second part is devoted to the essence of consumer protection, as well as its comparisons between the two countries. The last part includes a comparison of the legal regulations related to consumer contracts of the Czech Republic and the Russian Federation. As the result of the work, it was found the similarities and differences between the laws of both countries. The main finding was that the Russian legislation lags far behind the Czech legislation in the area of consumer contracts. In summary of the issue, the author of the bachelor's thesis offers a recommendation “de lege ferenda”.
