The Settlement of Claims from the Motor Third Party Liability Insurance

Abstract:

Diplomová práce „Likvidace pojistných událostí z POV“, navazuje na předcházející práci bakalářskou, ve které byly popsány a analyzovány základní aspekty této problematiky. Cílem práce je zjistit, jaké podstatné vlivy působí v současné době na pojistitele provozující pojištění odpovědnosti za škodu způsobenou provozem vozidla a zároveň analyzovat dopady těchto vlivů do procesu likvidace pojistných událostí na vozidlech, a to včetně stanovení náhrady škody. K dosažení uvedeného cíle je proveden rozbor změn právního prostředí, ale také rozbor dalších významných faktorů, kterými jsou například vlivy tržního prostředí, skladba vozového parku, či problematika pojistného podvodu. Zjištěné skutečnosti a teoretické předpoklady jsou následně verifikovány reálnými likvidačními procesy významných pojistitelů působících v České republice. Na základě získaných poznatků, jak dílčích, tak i celkových, je hledáno možné řešení.

Abstract:

This dissertation „The Settlement of Claims Arising from the Motor Third Party Liability Insurance” follows upon my earlier bachelor’s thesis which described and analysed the key aspects of this issue. The aim of this dissertation is to identify which of the fundamental influences currently represent the key drivers for insurers providing the Motor Third Party Liability Insurance and to analyse their impact on the process of settlement of claims arising from the Motor Third Party Liability Insurance, including the determination of damages. In order to fulfill the aim of this dissertation I have analysed changes to the legal framework and also other important factors such as the impact of the market environment, the composition of a car fleet or the issue of insurance frauds. The collected data and theoretical assumptions are subsequently verified by actual settlement process applied by the key insurers active in the Czech Republic. I have tried to find a solution on the basis of the obtained knowledge, both partial and overall.
