Health Care and the Protection of Personal Rights

Abstract:

Ochrana osobnosti je celosvětově aktuální problém, jehož význam ve společnosti stále roste. Přesto musím podotknout, že je tato otázka v ČR stále podceňována a to zejména v tak citlivé oblasti jako je poskytování zdravotní péče.V úvodu své práce jsem vymezila klíčové pojmy své práce. Rozebírám právo na ochranu osobnosti, jeho předmět i obsah. Úvodem třetí kapitoly jsem se věnovala definici pojmů spojených se zdravotnictvím - zdraví, pacient, zdravotní péče, abych tak uvedla problematiku zdravotnického práva.Stěžejním tématem mé práce je právo pacienta na ochranu osobnosti. Krátce jsem zmínila i aspekt ochrany osobnosti zdravotníků. Cílem práce je popsat problematiku ochrany osobnosti s důrazem na právo na tělesnou integritu. Konkrétně jsem rozebrala otázku práva na život, jenž je základním východiskem univerzálního katalogu lidských práv.Rozebírám také problematiku asistované reprodukce s přihlédnutím k připravované právní úpravě. Závěr mé práce je věnován právu člověka důstojně rozhodnout o ukončení svého života. Popisuji jednotlivé formy euthanasie a porovnávám zahraniční právní úpravu. Tato problematika v ČR vzbuzuje velké emoce vzhledem k připravovanému novému trestnímu zákoníku, jenž za usmrcení ze soucitu a na žádost stanovuje snížené tresty.

Abstract:

Protection of person is a contemporary worldwide-spread problem, whose significance in the society keeps growing. In spite of that I should underline that this issue seems to be underestimated in the Czech Republic, being neglected in such a sensitive area as provision of healthcare is. In the introduction of my thesis, I defined the key terms of my work. I carry on analysing the right to protection of person, its subject and contents.At the beginning of the third chapter I paid attention to definition of terms related to healthcare sector health, patient, healthcare, so that I would introduce the problems of medical law.The principal theme of my thesis is the right of the patient to protection of person. I mentioned in brief also the aspects of protection of person of the medical staff. The goal of my thesis is to describe the problems of protection of person laying emphasis on the right to a physical integrity. I made a more detailed analysis of the question concerning the right to life, which is the essential point of departure of the universal catalogue of human rights.I further analyse the problems of assisted reproduction taking into consideration the prepared legal regulations.The conclusion of my thesis is devoted to the right of a man to a dignified decision of termination of his or her life. I describe individual forms of euthanasia and compare foreign legal regulations. These problems raise extensive emotional reactions in the Czech Republic with respect to the prepared amendment of the criminal code, which prescribes lower punishments for merciful killing or killing upon the person's request.
