Abstract:

Autor se v této diplomové práci zabývá tématem právní kontinuity Československé republiky z let 1938 1945 a s tím spojenou otázkou tvorby dekretů prezidenta republiky. V úvodu této práce se pokouším rozebrat pojmy, které úzce souvisí s tímto tématem. V další kapitole chronologicky popisuju historické okolnosti, které přivedly Evropu na práh 2. Světové války a pro Československou republiku měly nedozírné následky v podobě uzavření mnichovské dohody. Důsledkem této dohody byl postupný rozpad a zánik československého státu v podobě nacistické okupace. Dále popisuju úsilí a snahu československých představitelů, kteří odešli do emigrace, o vytvoření prozatímního státního zřízení v podmínkách exilu. Následující kapitola popisuje problém s vydáváním zákonných norem ve výše uvedených podmínkách a jeho řešení prostřednictvím dekretů prezidenta republiky. Taky je zde rozebrán způsob jejich tvorby a vzniku. V další části autor uvádí vybrané příklady těchto dekretů z různých období jejich vzniku. A na závěr rozebírá otázku jejich dodatečného schválení a začlenění do československého právního řádu po konci války, včetně jejich dopadů a následků až do současnosti.

Abstract:

The author of this thesis deals with the issue of the legal continuity of the Czechoslovakian Republic between 1938 - 1945, and along with this topic with the matter of creation of the presidential decrees. In the beginning of the thesis, the terminology connected with the particular topic is concerned. In the next chapter, the author provides the reader with chronological compilation of historical events that led the Europe up to the brink of World War II, and that caused fatal consequences for the Czechoslovakian Republic in the form of the Munic Pact. The consequence of this pact was a continous disintegration and downfall of the Czechoslovakian state in the form of Nazi occupation. Further, one deals with the strive of the Czechoslovakian representatives who lived in exile, for creation of interim government in the exile. The following chapter describes the problems of declaration of legal norms in the above mentioned conditions, and its solution through declaration of the presidential decrees. Here, the basic means of their creation are concerned. In the next part, the author provides us with chosen examples of these decrees from the various periods of their creation. As a conclusion, one deals with the issue of their subsequent affirmation and inclusion into the Czechoslovakian legal system after the end of Word War II, including their impact and consequences in the present.
