Resolving parental conflict, including the Cochem practice method

Abstract:

Tato rigorózní práce pojednává o způsobech řešení rodičovského konfliktu, a to ať už se jedná o řešení konfliktu v případě sezdaných či nesezdaných rodičů dětí. V práci se zaměřuji jak na řízení o úpravě poměrů k nezletilým dětem (tedy na soudní řešení), tak i na jiné způsoby řešení včetně metody Cochemské praxe. Metodě Cochemské praxe je věnována třetí část této rigorózní práce za účelem zjištění, zda tato metoda opravdu může být modelem (při zohlednění jejích výhod i limitů), který by mohl napomoci řešení rodičovského konfliktu a mohl by alespoň zčásti pomoci minimalizovat vytíženost českých soudů. Práce je doplněna nejen o praktické zkušenosti odborníků zaměřujících se na metodu Cochemské praxe, ale taktéž o zdroje z oblasti psychologie a sociologie. Dle mého názoru je totiž v této matérii potřeba nejen právního zhodnocení legislativní úpravy a souvisejících procesních postupů, ale i posouzení z pohledu jiných humanitních oborů. Závěr této rigorózní práce je věnován návrhům "de lege ferenda".

Abstract:

This rigorous thesis deals with ways of resolving parental conflict, whether it is a conflict resolution in the case of married or unmarried parents of children. In the thesis I focus on how on the proceedings for the adjustment of relations to minor children (i. e. court resolution), as well as on other methods of resolution, including the Cochem method of practice. The third part of this rigorous thesis is devoted to the Cochem practice method in order to find out whether this method can really be a model (taking into account its advantages and limitations) that could help to resolve parental conflict and could at least partly help to minimize the workload of Czech courts. The work is supplemented not only by the practical experience of experts focusing on the Cochem method, but also by sources from the field of psychology and sociology. In my opinion there is a need in this matter not only for a legal evaluation of the legislative regulation and related procedural procedures, but also for an assessment from the perspective of other humanities. The conclusion of this thesis is devoted to "de lege ferenda" proposals.
