Termination of Flat Rental

Abstract:

Tématem bakalářské práce bylo zánik nájmu bytu. V práci byly analyzovány veškeré způsoby zániku nájmu bytu, ke kterým může v českém právním řádu dle současné platné a zároveň účinné právní úpravy dojít, a to jak obecné důvody zániku právního vztahu, tak také zvláštní důvody, typické pro nájemní právní vztah, kde předmětem je byt. Důvody zániku nájmu bytu byly v práci rozděleny na absolutní způsoby zániku nájmu bytu a na způsoby relativní. Zvláštní důraz byl kladen na způsob zániku nájmu prostřednictvím výpovědi pronajímatele nájemci s přivolením a bez přivolení soudu, který je v praxi nejfrekventovanější a nevýraznějším důkazem ochranářské pozice nájemce v právním vztahu dle občanského zákoníku. V souvislosti s tímto způsobem zániku nájmu bytu byl zmíněn též institut bytové náhrady. V bakalářské práci bylo zejména poukázáno na výrazné změny, ke kterým v problematice zániku nájmu bytu došlo v letech 2007 a 2011, kdy byly realizovány významné novely občanského zákoníku. V závěru bakalářské práce je potom nastíněna právní úprava zániku nájmu bytu podle nového občanského zákoníku, který již prošel celým legislativním procesem a nabývá účinnosti dnem 1.1.2014.

Abstract:

The subject of this thesis is an extinction of a flat rental. There were analyzed all forms of the extinction of flat rental which can occur in the Czech legal system according to the current valid and at the same time effective legislation, including general reasons of the extinction of a legal relation, and special reasons which are typical for lease legal relation concerning a flat. In the thesis the reasons of the extinction of a flat rental were divided into absolute forms of the extinction and relative forms. Special emphasis was put on the form of extinction by means of lessor´s notice given to the lessee with and without the consent of the court, which is the most frequent and the most distinctive evidence of the protective position of a lessee in legal relation according to the civil code. In connection with this form of a flat rental extinction was mentioned an institute of flat substitute. In the thesis were mainly accentuated distinctive amendments which were realized in the field of flat rental extinction in the years 2007 and 2011, when significant amendments of the civil code were implemented. In the conclusion of the thesis is suggested a legal modification of the flat rental extinction according to the new civil code, which has already undergone the whole legislative process and comes into effect on 1st January 2014.
