The Influence of Case Law on the Activities of the Tax Administrator in the Tax Control Process

Abstract:

Cílem diplomové práce je ověřit, zda současná právní úprava a výkon daňové kontroly odpovídají deklarovaným cílům zákonodárce a celospolečenské potřebě na potírání daňových deliktů. Diplomová práce chce poskytnout stručný vhled do vzájemné interakce složek státních mocí, zkoumat bude zejména vliv soudní moci na výkon daňové kontroly. Představí vybrané procesní postupy daňové kontroly, které novela daňového řádu zjednodušila a fungují obdobně na Slo-vensku i v Polsku. Stěžejní část diplomové práce je zaměřena na oblast odpočtu na podporu výzkumu a vývoje. Tato oblast není v odborné literatuře uceleně zpracována. Současně poskytuje prostor i pro zkoumání dílčích hypotéz, jako například soudní rozhodnutí často nahrazují nedokonalou tuzemskou legislativu nebo soudní rozhodnutí ovlivňují činnost správce daně s velkým zpožděním. Di-plomová práce vychází z právního stavu k 28. 2. 2021.

Abstract:

The aim of the thesis is to verify whether the current legal framework and exer-cise of tax audit are in accordance with the declared legislature´s aims as well as the needs of society for fighting against the tax offences. The thesis provides brief insight into mutual interaction of state powers. It will especially focus on impact of the judiciary on tax audit. There will be introduced chosen procedural practices of tax audit simplified by the amended Tax Code. These practices work similarly in Slovakia and Poland. The main part of the thesis is focused on the field of tax deduction for support of research and development. There is no comprehensive study in current specialized literature yet. The field of tax deduc-tion for research and development will be used for explores partial hypotheses such as: (i) practice of the courts regarding tax law is often replacing imperfect local legislation or (ii) practice of the courts have effect on the tax audit and legislation with great delay. The thesis is based on legal status as of 28 February 2021.
