The Role and Influence of NGOs on TRIPS and Public Health Discourse Formation

Abstract:

Práce se v obecné rovině zajímá o vliv nestátních neziskových organizací na mezinárodní vztahy. Tuto problematiku zkoumá na problému Dohody o obchodních aspektech práv k duševnímu vlastnictví, jejíž přijetí se dostalo do konfliktu s veřejným zdravím. Neziskové organizace jako první na tento fakt upozornily a zasazovaly se o to, aby došlo ke změně dohody. Jejich rozsáhlá snaha napomohla tomu, že byla nakonec skutečně změna dohody v radě Světové obchodní organizace přijata. Nelze však tvrdit, že by neziskové organizace měly sami o sobě tak podstatný vliv. Míra jejich vlivu na proces, který se kolem TRIPS odehrává, se mění se společenskými podmínkami. Pokud jsou vnější podmínky pro neziskové organizace příznivé a podaří se jim využít nabízených příležitostí, jejich vliv stoupá. Naopak, když okolní podmínky přestaly neziskovým organizacím nahrávat, tak stále stejně intenzivní činnost již nestačila k tomu, aby mohly ovlivňovat proces do takové míry jako předtím.

Abstract:

This thesis deals in general dimension with degree of influence of non-governmental organizations on international relations. This issue is scrutinized on the problem surrounding TRIPS Agreement, which has come into conflict with public health. Non-governmental organizations drew the attention to this fact as the first and they have advocated an amendment of the TRIPS Agreement. Their extensive endeavour led to the final adoption of the TRIPS amendment by the Council of the World Trade Organization. However, it cannot be claimed that non-governmental organizations alone had such substantial influence. Degree of their influence on the TRIPS process has varied with external conditions. When external conditions were favourable and non-governmental organizations were able to take advantage of offered occasions, influence of NGOs increased. On the contrary, when external conditions changed and were less favourable for non-governmental organizations, their endeavour of the same intensity was not sufficient enough to influence positively process according their view with the same extent as before.
