Forest Protection

Abstract:

Les je jednou ze základních složek životního prostředí. Jako jeden z nejsložitějších ekosystémů plní nenahraditelné funkce a je obecným celospolečenským zájmem zachování lesa jako cenného přírodního bohatství i trvalé a vyrovnané využívání a ochrana všech jeho funkcí. Za tímto účelem je nezbytné, aby stát les chránil a podílel se tak na zabezpečení jeho produkčních i mimoprodukčních funkcí. Cílem této diplomové práce je proto v rámci možností daných jejím rozsahem souhrnně rozebrat ochranu lesa současnou českou právní úpravou lesům poskytovanou. Samostatná pozornost je věnována právům a povinnostem vlastníka lesa, ochraně pozemků určených k plnění funkcí lesa, tradičnímu institutu obecného užívaní lesa, specifické ochraně lesa jako nedílné součásti přírody a krajiny v režimu zákona o ochraně přírody a krajiny, nástrojům právní úpravou k ochraně lesa využívaným a institutu právní odpovědnosti. V neposlední řadě se práce zabývá dozorem nad dodržováním povinností zákonem a na základě zákona k ochraně lesa uložených.

Abstract:

Forest is one of the basic components of the environment. Being one of the most complicated and complex ecosystems, forest carries irreplaceable functions and accordingly the conservation of forests as priceless natural assets and the permanent and continual exploitation and protection of all their functions is the all society interest. For this purpose the state necessarily has to protect forests and thus contribute to the support of their production and non production functions. Consequently, the aim of this thesis is to deal with the protection provided to forests by the present Czech legislation as far as this is possible regarding the intended scope of the thesis. Special attention is concentrated on the rights and obligations of forest owners, the protection of forest land, the traditional legal institute of public use of forests, special protection of forest as the inseparable part of nature through the relevant provisions of the Protection of Nature and Landscape Act, legal tools used by the legislation to achieve the forest protection and liability. Last but not least, the thesis deals with the control and supervision over the compliance with the duties imposed by law in order to protect the forest.
