Abstract:

Na samém začátku jsem vycházela z myšlenky, že ve své práci popíši mezinárodní justiční spolupráci v trestních věcech v souvislosti s aktuální právní úpravou, tedy s ohledem na zákon č. 104/2013 Sb., o mezinárodní justiční spolupráci v trestních věcech a poukáži na nedostatky či pozitiva této právní úpravy. Tato úprava je poměrně nová a reagovala na potřebu konzistentně, přehledně a komplexně upravit tuto problematiku a umožnit rychlou a jednoduchou komunikaci mezi příslušnými orgány České republiky a cizích států, která by zajistila jejich součinnost za účelem efektivního boje s trestnou činností. Zabývala jsem se novinkami v současné právní úpravě, porovnávala jsem ji s předcházející úpravou, přiblížila problematická ustanovení a nastínila možný budoucí vývoj.

Abstract:

At the very beginning I worked with the ideal that my thesis will describe international judicial cooperation in judicial matters in connection with the current legislation, i.e. with regard to the Act no. 104/2013 Coll., on International Judicial Cooperation in Criminal Matters. This regulation is relatively new and it responded to the need to consistently, transparently and comprehensively govern this issue and to allow an expedited and uncomplicated communication between the competent authorities of the Czech Republic and foreign states that would facilitate their cooperation in order to effectively combat crime. I employed myself with novelties of the current legislation, compared it with the former regulation, expounded some of the problematic provisions and outlined possible future development.
