Informed Consent in the Medical Law

Abstract:

Uznání práv pacientů, a zejména práva na informovaný souhlas před lékařským zákrokem, v podobě jakou do českého právního řádu přinesla Úmluva, bylo nezbytným krokem v aproximaci českého medicínského práva standardům Evropské unie. Přijetím Úmluvy byl položen nový základ medicínského práva v České republice, ale reforma medicínského práva je stále odkládána. V této práci autor dokazuje řadou teoretických i praktických příkladů, medicínských, právně aplikačních i právně komparatistických, že problematika informovaného souhlasu pacienta a jeho souvisejícího poučení s sebou nese řadu teoretických i aplikačních problémů, zvláště ve světle výkladu Úmluvy o biomedicíně při současné existenci stávající zastaralé vnitrostátní zákonné úpravy. Přijetí Úmluvy o biomedicíně pak představuje zásadní změnu obsahu aplikovatelného práva přesto, že se že vnitrostátní úprava de lege lata dosud v podstatě Úmluvě nepřizpůsobila. Přistoupením České republiky k Úmluvě se tak skutečně výrazně zvýšil teoretický standard ochrany pacienta. Pacientům v uplatňování jejich práv dle zásad a principů vymezených Úmluvou nic formálně nebrání. Přímé uplatňování práv pacientů podle Úmluvy umožňuje její charakter, který ji řadí do režimu čl. 10 Ústavy a skutečnost, že Úmluva požaduje svou přímou aplikaci v případě, kdy jsou její ustanovení v rozporu s vnitrostátní úpravou, je-li ochrana podle Úmluvy v takovém případě vyšší. Přímo aplikovat tak lze především ustanovení čl. 5 Úmluvy týkající se řádného poučení pacienta, ovšem při bližším zkoumání i celou řadu dalších ustanovení. Informovaný souhlas pacienta se musí především řídit principy zavedenými do právního řádu ČR Úmluvou, přičemž inspirační východiska lze shledávat také v zahraničních právních úpravách zemí právního systému Common Law, ve kterých je institut informovaného souhlasu tradiční a teorií kvalitně rozpracovanou součástí platného práva již několik desítek let, obdobně je tomu s právní úpravou v německy hovořících zemích, které jsou z inspiračního hlediska zajímavé především obdobnou právní tradicí a dřívější implementací subjektivněprávních institutů medicínského práva.

Abstract:

As a result of adoption of the Convention on Human Rights and Biomedicine by the Czech Parliament in 2001 there is an extensive shift of the entire Czech medical law to the benefit of the patient's autonomy and freedom of will. Simply for the fact that the Article 10 of the Czech Constitution acknowledges the ratified and published international treaties and conventions as superior to the national laws and at the same time the Convention provides for its direct application in case the national law protection of the patients' rights is on a lower degree than the Convention's one. The Convention sets forth the main human rights and freedoms in relation to the medical care. Generally, and particularly in case of requirements on informed consent of an individual patient, the Convention requires higher protection regime than the current Czech law does. In such case the international treaty has to be applied as superior to the national law. Particularly, the requirements for the informational background the patient needs have risen significantly too. The existing legislation required the disclosure of information to be adequate, or reasonable, whereas the new arrangment under influence of the Convention on Biomedicine requires higher regime of the information provided to be extensive and due. Even though the adoption of the Convention anticipates further aproximation of the national law, the necessary steps were not taken until now. The Convention not only enforces a number of new rights of the patients, it also creates a lot of duties laid on medical staff. This thesis demonstrates on various theoretical and practical examples, all medical, legal, comparative and others, that the informed consent and information disclosure requirements bring a vast number of problems in all means in perspective of the Convention and the existing Czech legislation. The informed consent application and requirements, as this thesis also demonstrates, has to follow the principles intoduced to the Czech legal system by the Convention on biomedicine. The inspirational resources for the updated Czech law have to be searched particularly in the western legal systems, accustomed to the principles new for the Czech Republic. The informed consent, chiefly, became common in the countries of the Common Law, it is stable element of its legal system and its principles are extensively elaborated in both the theoretical legal works and the court decisions. German speaking countries are accustomed to those principles in a similar way. Besides from the perspective of similarity of the rule of law, the German law is even closer to the Czech law. This thesis emphasizes the need to accelerate the process of conversion from the traditional paternalistic approach of the doctors to the patients and the need to abandon their unwillingness to adapt themselves to the changes demandend by the community-wide movement of apprehension of the patients' rights.
