Judicial Protection of Fundamental Human Rights and Freedoms

Abstract:

Tato práce se zabývá základními lidskými právy a jejich ochranou. V úvodní části popisuje filozofické zdůvodnění lidských práv a dějinné procesy, které se podílely na formování celého konceptu lidských práv, současně vymezuje pojem právního státu. V druhé části se předložená práce věnuje významu Listiny základních práv a svobod, její systematice a rozboru judikatury Ústavního soudu České republiky. V rámci vnitrostátní procesní ochrany se práce zaměřuje na obecné a ústavní soudnictví, zvláštní pozornost je věnována institutu ústavní stížnosti. Na závěr jsou vysvětleny mezinárodní mechanismy ochrany lidských práv v globálním, tak především v evropském měřítku s odkazem na Evropský soud pro lidská práva.

Abstract:

The topic of this thesis are the fundamental human rights and the protection of these rights.The preamble describes the philosophical reasons for human rights as well as the historical events, which participated in forming of the human rights concept and specifies the term Rule of law.The second part of the presented thesis is dedicated to the meaning of Bill of rights system, and the analysis of Court ruling of the Constitutional court of the Czech republic. The thesis focuses on general and constitutional judicature within the framework of national process warrant. The institution of Constitutional complaint is given a special consideration.The conclusion explains the international mechanism of human rights protection on the global and mainly European scale with reference to the European court of human rights.
