Abstract:

Ve své práci jsem se snažila vystihnout podmínky a možnosti obcí pi vydávání obecn závazných místních právních pedpis. Vycházela jsem zejména ze zákona . 128/2000 Sb., o obcích, Ústavy R a Listiny základních práv a svobod, jakožto i dalších právních pedpis a literatury, která se dané problematiky týká. Obec je veejnoprávní územní korporace. Je tradiním základem územní samosprávy. Charakteristickými znaky obce jsou vlastní území (územní základ obce), obyvatelstvo (personální základ obce), vystupování v právních vztazích svým jménem právní subjektivita (právní základ obce) a vlastní majetek a hospodaení podle vlastního rozpotu (ekonomický základ obce). Právní postavení obce je dáno jejími základními znaky, psobností, pravomocí a vztahy vi státu, fyzickým a právnickým osobám. Psobností obce rozumíme právn vymezený okruh spoleenských vztah (okruh svených úkol), které mže obec regulovat. Rozlišujeme psobnost vcnou, územní a osobní. Uvnit tohoto okruhu pak obec realizuje svou pravomoc. Tu lze definovat jako souhrn právních prostedk (tedy oprávnní a právních povinností), které jsou obci jako subjektu veejné správy dány k plnní jejích úkol. eské právo rozlišuje psobnost obcí dvojím zpsobem: tzv. samostatnou a penesenou psobnost. Samostatná psobnost vymezuje prostor, ve kterém obec uskuteuje ústavou podložené právo na samosprávu. Penesená psobnost je pak dekoncentrovaná státní správa svená obcím zákony. Jde tedy o úkoly, které obec plní pro stát. Územní samospráva má i zákonodárnou (normotvornou - právotvornou) funkci, tzn., že sama rovnž právní pedpisy tvoí. Pi výkonu státní správy jde o tvorbu právních pedpis odvozených a podzákonných,. Tento druh právních pedpis je oznaován jako naízení. Pi výkonu samosprávy je naopak zdraznn samosprávný charakter obcí. Zde stát ponechává samosprávným orgánm z hlediska jejich tvorby plný prostor, tzn. pravomoc k tvorb vlastních mocenských akt a realizace právotvorné pravomoci. Tato právotvorba je originální, jde o tvorbu právních pedpis, které jsou pvodní, od zákon neodvozené. Takové právní pedpisy oznaujeme jako obecn závazné vyhlášky. Jejich prostednictvím mohou obce svobodn rozhodovat ve svých vcech. Všechny právní pedpisy, tedy i právní pedpisy obce, mají vždy abstraktní charakter, tzn. že se vztahují na neuritý poet subjekt (fyzických a právnických osob) a na neuritý poet pípad stejného druhu, které v budoucnosti nastanou nebo mohou nastat. Vymezují tedy pouze obecnou skutkovou podstatu a v žádném pípad nemají ešit konkrétní jednotlivý pípad. Právní pedpisy obcí tak obsahují obecn závazná pravidla chování, která se vztahují na blíže neurený okruh adresát. Obce se pi vydávání právních pedpis ídí Ústavou eské republiky, ústavními zákony, mezinárodními smlouvami a zákony, pi vydávání naízení navíc i jinými právními pedpisy. O vlastní procedue legislativního procesu, tzn. píprav, projednání a schválení návrhu zákon o obcích neíká tém nic. Podmínkou platnosti právních pedpis obce je jejich publikace pijatý právní pedpis je vyhlášen zákonem stanoveným zpsobem. Tím se stává souástí právního ádu. Okamžikem vyhlášení nabývá právní pedpis platnosti a je dokonen proces jeho vzniku. Platnost pedpisu je základní podmínkou jeho pípadné aplikace. Právní pedpis pozbývá platnosti svým zrušením. Pro místní právní pedpisy platí, že jsou v pípad jejich nerespektování ze strany adresát vynutitelné státní mocí (stejn jako všechny právní pedpisy). Sankce tak pedstavuje nástroj k dodržování právních norem. Pi výkonu dozoru jsou dozorové orgány oprávnny požadovat na obci poskytnutí informací potebných pro výkon dozoru. uje soulad právních pedpis obcí se zákony. Právo pozastavit úinnost právního pedpisu náleží pouze státním orgánm Ministerstvu vnitra R nebo vcn píslušnému ústednímu správnímu úadu. Právní pedpisy obcí (píp. jejich jednotlivá ustanovení) mohou být zrušeny jen Ústavním soudem R. Závr práce obsahuje úvahu de lege ferenda s možnými návrhy na ešení souasné úpravy vydávání místních právních pedpis obcemi.

Abstract:

In my project I have attempted to formulate conditions and possibilities for municipalities to issue municipal ordinance local legal regulations. I consulted the Municipal Law no. 128/2000 collection, the Constitution of the Czech Republic and Charter of the Fundamental Rights and Freedoms, and also other legal regulations and literature which deal with the given area. A municipality is a public territorial corporate entity. It is the traditional basic element of the local autonomy. Characteristic features of the municipality, include the territory (municipality founding territory), population (municipality personal base), representing itself as a body in legal relations - legal personality (municipality legal foundation) and ownership of property and to administer its own budget (municipality economic base). The legal status of the municipality is provided by its basic features, competence, authority and relations towards the state, natural persons and legal entities. By competence of the municipality it is understood to be legally defined sphere of social relations (sphere of entrusted tasks), which the municipality can regulate. Material, territorial and personal competences are differentiated. Inside this sphere the municipality implements its authority. This can be defined as a summary of legal regulations (i.e. competence and legal obligations), which are given to the municipality as a subject of public affairs to manage its tasks. Czech law distinguishes the competence of the municipality in two ways: so called independent and delegated competence. Independent competence specifies the area where the municipality implements the rights for autonomy based on the Constitution. Delegated competence is a deconcentrated state administration entrusted to municipalities by law. These are tasks which the municipality carries out for the state. Territorial autonomy also has legislative (norm-forming law-forming) function, i.e. that it creates legal regulations. While enforcing state power a concern is the formation of derived and grounded legal regulations. This type of legal regulation is called a bylaw. While executing the authority, however, the autonomous character of the municipality is underscored. Here the state allowes the autonomous organs full reign from the standpoint of their creation, i.e. authority to carry out its own acts of power and implementation of the law-forming authority. This law-formation is original, it is the creation of legal regulations which are original and not derived from the law. Such legal regulations are called municipal ordinances. Through these, the municipalities can independently decide about their affairs. All legal regulations, including municipal legal regulations, always have an abstract character, i.e. they apply to an indefinite number of subjects (individual and legal entities) and to an indefinite number of cases of the same kind, which will or might arise. They only define the general facts of the case and under no circumstances should they deal with a concrete individual case. Municipal legal regulations, therefore, contain generally binding rules of behaviour which refer to more closely non-defined sphere of addressees. When issuing legal regulations, municipalities comply with the Constitution of the Czech Republic, constitutional laws, international treaties and laws; when issuing bylaws other legal regulations also need to be complied with. About the procedure of the legislative process itself, i.e. preparation, reading and approval of the proposal Municipal Law mentions hardly anything. Validity of the municipality legal regulations is preconditioned by its publication accepted legal regulation is promulgated by law in the prescribed way. By that it becomes part of the rule of law. ble application. The legal regulation is invalidated through annulment. It is valid for local legal regulations that in the case that they are not respected by the addressees, they are the enforceable by the state authorities (as well as all other legal regulations). Sanctions therefore represent an instrument of respect of legal norms. When supervising the supervisory bodies are entitled to request from the municipality to be provided with information necessary to perform supervision. Supervision is performed post factum. The conformity of municipal legal norms to law is assessed during supervision. The right to suspend the force of legal regulations belongs exclusively to the state organs to the Ministry of Interior of the Czech Republic or pertinently appropriate official administrative authorities. Municipal legal regulations (possibly their individual regulations) can be invalidated only by the Constitutional Court of the Czech Republic. The conclusion of the project includes an essay de lege ferenda with possible proposals for the solution of the current framework for issuing local legal regulations by municipalities.
