Review of Czech Criminal Proceedings

Abstract:

Tato práce si klade otázku, v jaké kondici se v současnosti nachází české trestní právo procesní a co jej očekává v následujících dekádách. Je nutno si otevřeně přiznat, že české trestní řízení v současné době poněkud přešlapuje na místě. Koncepce, na níž byla jeho moderní podoba v roce 1961 postavena, se od roku 1989 drolí, ne-li rozpadá s tím, jak se mění společenské poměry, postavení veřejné moci obecně a orgánů činných v trestním řízení zvláště a okruh záležitostí, které musí regulovat. Nejprve tato práce podává charakteristiku výchozí pozice, tj. stavu, v němž se naše trestně-procesní úprava dnes nachází. Poté se podrobněji věnuje dílčím aspektům koncepce trestního řízení. Konkrétně se jedná o vztah trestního práva hmotného a procesního, proměnu trestně-procesních vztahů a z ní vyplývajících změn v postavení poškozeného, problematiku odklonů v trestním řízení a procesní aspekty řešení terorismu.

Abstract:

This thesis poses question, in what shape the Czech law of criminal procedure finds itself and what the upcoming decades have in store for it. It is necessary to come clean that it has stalled a bit. Conception upon which its modern shape was built in 1961, has crumbled if not fallen apart since 1989 in relation to the change of the social conditions, the position of the public power as whole in general and the position of the law enforcement and criminal justice in particular, as well as in relation to how the scope of affairs it has to deal with has changed. Firstly, this thesis provides characteristics of the default position, i. e. the state in which our regulation of criminal procedure finds itself today. After that, it pays closer attention to particular aspects of the conception of the criminal proceedings. These are the relation between the criminal substantive and procedure law, the change of criminal-procedural legal relations and the changes in the position of the aggravated party that stems from it, the problem of diversions in the criminal proceedings and the procedural aspects of dealing with cases of terrorism.
