Responsibility of the judicial officer by practice of proffesion and disciplinary responsibility of the judicial officer

Abstract:

The thesis aims at presenting the topic of the activities of a judicial executor performed in connection with damage liability, breach of legislative rules and regulations as well as disciplinary liability ´s objectiveof the thesis. The bachelor thesis deals with the responsibilities of a judiciary executor in performing his profession as well as the disciplinary liability of a judiciary executor. The thesis has been divided to three chapters. The first chapter focuses on the historical development and reviews the beginnings (origins) of executions. The second chapter provides a more detailed analysis of the Code of Conduct (Ethical Code) of a judicial executor. The third chapter studies in a greater detail the practical comparison of responsibility of executors in performing their profession with other legal professions. The conclusion of the study is a summary of results of the implemented analysis as well as the emphasized underlying need of further continuous study and research of the topic, which should be developed and possibly made more accurate and proper through legislative amendments in the future.

Abstract:

Cieľom záverečnej práce je priblížiť problematiku výkonu povolania súdnych exekútorov pri spôsobení škody, porušení právnych predpisov, ako aj disciplinárnej zodpovednosti. Bakalárska práca sa zaoberá zodpovednosťou súdneho exekútora pri výkone povolania a disciplinárnou zodpovednosťou súdneho exekútora. Práca je rozdelená do troch kapitol. Prvá kapitola je zameraná na historický vývoj a pohľad na počiatky exekúcií. Druhá kapitola bližšie analyzuje a rozoberá Etický kódex súdneho exekútora. Tretia kapitola sa podrobne orientuje na praktické porovnanie zodpovednosti súdnych exekútorov pri výkone povolania ako aj ostatných právnických povolaní. Záverom riešenia danej problematiky je zhrnutie výsledkov vykonanej analýzy a zdôraznenie podnetu, že táto problematika by sa mala naďalej skúmať a rozvíjať, prípadne precizovať legislatívnou úpravou v budúcnosti.
