Abstract:

Tato bakalářská práce popisnou metodou charakterizuje správní delikty účetní jednotky, které mohou být spáchány při zaúčtování a vykazování účetních transakcí podle zákona o účetnictví. V teoretické části jsou vymezeny základní pojmy týkající se konstrukce správně právních jednání a odpovědnosti na ně. Jsou popsány zásady a instituty správního řízení, ve kterém jsou tato účetní pochybení řešena věcně a místně příslušným finančním úřadem. Aplikační část je věnována popisu šesti konkrétních účetních pochybení vybrané účetní jednotky. Jednotlivá pochybení jsou podrobena důkladnému rozboru. Součástí práce jsou návrhy konkrétních opatření pro zamezení popsaných účetních pochybení v dalším účetním období. V závěru aplikační části je navrhováno, zda a v jaké fázi správního řízení využít opravného prostředku (odvolání) proti rozhodnutí prvostupňového správního orgánu s konstatováním o pravděpodobnosti úspěchu odvolání.

Abstract:

This bachelor thesis offers an insight into the administrative offenses of an entity that can be committed in accounting and reporting accounting transactions under the Accounting Act. The thesis is divided into several chapters. The theoretical part defines the basic concepts related to the construction and responsibility of legal acts. Furthermore, principles and institutes of administrative proceedings are described with regard to accounting errors, which are resolved by the competent tax office. The application part is devoted to the description of six specific accounting errors of the selected entity. In addition, individual errors are thoroughly analyzed. Finally, the thesis contains suggestions of concrete measures that can be taken to prevent accounting errors in the following accounting period. At the end of the application part, there are recommendations regarding whether and when it is appropriate to use the administrative appeal procedure against the decision of the first-instance administrative authority coupled with information about the probability of a successful appeal.
