Review of the Management of Municipalities in the Czech Republic

Abstract:

Diplomová práce uceleně popisuje současné právní a ekonomické aspekty zabezpečení přezkoumání hospodaření obcí v České republice. Její stěžejní část je zaměřena na komparaci způsobu a závěrů z pře-zkoumání vykonávaného krajským úřadem a z přezkoumání vykonáva-ného auditorem či auditorskou společností. Cílem práce je v její teore-tické části zhodnotit hmotněprávní a procesněprávní úpravu vztahující se k právnímu rámci zabezpečení přezkoumání hospodaření obcí. V praktické části práce je pomocí dotazníkového šetření ověřována sta-novená hypotéza. Snahou autorky je na základě závěrů plynoucích z přezkoumání u vybraného vzorku obcí a na základě svých vlastních praktických zkušeností a výsledků z vlastního průzkumu posoudit, zda s ohledem na ekonomický i veřejný význam předmětu přezkoumání hos-podaření je stávající právní úprava dostatečná. Závěr práce obsahuje návrhy včetně úvah de lege ferenda.

Abstract:

This diploma thesis gives a comprehensive account of the current legal and economic aspects of the execution of the municipal management review in the Czech Republic. Its main part is focused on the methods and conclusions of the review performed by the Regional Authority as opposed to those performed by an auditor or auditing company. The aim of the theoretical part of the thesis is to the evaluate the legal regu-lation of the execution of the municipal management review in terms of the substantive and procedural law. The proposed hypothesis is verified in the practical part of the thesis by means of a questionnaire survey. The author uses the conclusions obtained from the reviews in a selected sample of municipalities together with her own practical experience to assess whether the current legislation is sufficient with respect to the economic and public importance of the municipality management re-view. The conclusion of the thesis includes proposals including the con-siderations for de lege ferenda.
