Impact of the new regulation of insurance intermediaries on the Czech insurance market

Abstract:

Tato bakalářská práce je zaměřena na analýzu dopadů zákona č.170/2018 Sb. Zákon o distribuci pojištění a zajištění na český pojistný trh. Za novou legislativou stojí původní záměr, se kterým se regulace zavádí. Původním záměrem byla transpozice směrnice EU do vnitrostátního práva a zvýšení úrovně ochrany spotřebitele. V ideálním případě bude mít zavedení nových pravidel pouze žádoucí a předem očekávané dopady na regulovaný sektor. Může ale nastat situace, kdy naopak v důsledku nových regulatorních pravidel dojde k neočekávaným a nežádoucím změnám. Cílem této bakalářské práce bude subjektivní hodnocení dopadů nové regulace na základě vybraných souhrnných ukazatelů o českém pojistném trhu a na základě subjektivních názorů autora. Výsledkem práce by mělo být shrnutí konkrétních dopadů na činnost pojišťovacích zprostředkovatelů v podobě vybraných paragrafů zákona č. 170/2018 Sb., zhodnocení dopadů nové regulace z pohledu různých subjektů pojistného trhu a vyhodnocení vývoje na českém pojistném trhu po zavedení nové regulace včetně identifikace případných nežádoucích dopadů.

Abstract:

This bachelor thesis focuses on the analysis of the impact of Act No.170/2018 Coll., the Act on Insurance Distribution and Reinsurance on the Czech insurance market. There was an intention behind the new legislation. The original intention was to transpose an EU directive into national law and to increase the level of consumer protection. Ideally, the introduction of the new rules will have only desirable and anticipated effects on the regulated sector. However, there may be situations where new regulatory rules result in unexpected and undesirable changes. The aim of this bachelor thesis will be a subjective assessment of the impact of the new regulation on the basis of selected aggregate indicators of the Czech insurance market and on the basis of the author's subjective opinions. The result of the thesis should be a summary of specific impacts on the activities of insurance intermediaries in the form of selected sections of Act No. 170/2018 Coll., an assessment of the impact of the new regulation from the perspective of various insurance market entities and an evaluation of the development of the Czech insurance market after the introduction of the new regulation, including the identification of possible undesirable impacts.
