Constitutional aspects of European Union membership

Abstract:

Disertační práce se zaměřuje především na analýzu obsahových změn ve vybraných oblastech, které bezprostředně souvisí se samotným členstvím států v Evropské unii. Jde přitom zejména o změny v právních řádech členských států, vycházející z evropského práva, respektive ze zakládacích smluv za platnosti Lisabonské smlouvy. Kromě toho se práce zabývá také popisnou analýzou širokého spektra změn, kterými prošly konkrétně právní řády Česka, Rakouska a Slovenska v souvislosti s přípravou na členství v ES/EU. Konkrétně se jedná 1) o problematiku vlivu členství na suverenitu členského státu, 2) o otázky spojené s problematikou dělby moci, 3) o možnosti ochrany lidských práv a základních svobod v systému garancí poskytovaných ze strany Rady Evropy, národních (ústavních) soudů a SDEU a 4) o problematiku participace jednotlivců na evropské úrovni politiky prostřednictvím institutu občanství EU. Všechny tyto oblasti jsou přitom nahlíženy v podmínkách výše zmíněných tří zemí teoreticky i prakticky a byly definovány s ohledem na závěry jiných autorů i s přihlédnutím na publikované poznatky autora této disertační práce.

Abstract:

The thesis focuses primarily on the contextual analysis of changes in selected areas, which are related to membership of individual states in the European Union. This is in particular the changes in the laws of the Member States, based on European law, and on the founding treaties for the validity of the Lisbon Treat. Moreover, the thesis also deals with a descriptive analysis of a wide range of changes in the legal systems of three selected states (Czech Republic, Austria and Slovakia). This is in particular the changes that are connected with preparation of these states for membership in the EC/EU. Namely, following fields are analyzed: 1) the issue of the impact of membership on the sovereignty of Member States, 2) issues related to separation of powers, 3) issues connected with the guarantee of human rights and fundamental freedoms provided by the Council of Europe, national (constitutional) courts and CJEU and 4) issues of participation at the European policy institute (here it is first of all the problem of EU citizenship). All these fields are defined with the respect to a) ideas of other works and b) works that have already been published by the author of this thesis.
