Some Aspects of Decision-making Practice of the Supreme Court of the Czech Republic focusing on the Legal Relations with Foreign Countries

Abstract:

Téma diplomové práce pojednává o působnosti a pravomoci Nejvyššího soudu České republiky v rámci problematiky právního styku s cizinou v trestních věcech. V úvodu práce je nastíněn historický vývoj Nejvyššího soudu v rámci trestní agendy až po současnou právní úpravu. Následuje stručné uvedení do právního styku s cizinou v trestních věcech, jeho jednotlivých zásad a forem. Navazuje exkurz do mezinárodní a zejména evropské právní úpravy oboru s popisem některých stěžejních institutů trestního práva procesního. Vše je propojeno v kapitole věnované některým konkrétním případům působnosti Nejvyššího soudu (přezkoumávání rozhodnutí soudů nižších stupňů, povolování průvozů osob, zaznamenávání údajů o odsouzení občanů do evidence Rejstříku trestů). Cílem diplomové práce je přinést ucelený pohled na zadanou problematiku, zhodnotit zejména českou právní úpravu obsaženou v trestním řádu, upozornit na její nedostatky a předložit náměty de lege ferenda.

Abstract:

ABSTRACT Thesis deals with the scope and powers of the Supreme Court of the Czech Republic in the issue of legal relations with foreign countries in criminal matters. The introduction outlines the historical development of the Supreme Court in criminal agenda to the current legislation. There is a brief introduction into legal relations with foreign countries in criminal matters, its principles and various forms. Next part deals with the international and particularly European regulatory field with a description of some of the key institutions of criminal procedural law. All the topics are linked in the chapter on some specific cases covered by the Supreme Court (reviewing decision of lower courts, permitting the transit of persons, recording information on convictions of citizens in the criminal record). The thesis aims to provide a comprehensive view of the given issue, especially to evaluate the Czech legal framework contained in the Penal Code, to highlight its weaknesses and provide suggestions on legal aspects.
