Employment contract of an agency employee

Abstract:

Tato práce se zaměřuje na téma "pracovní smlouva agenturního zaměstnance". Jejím úkolem je na základě nastudování odborné literatury a internetových zdrojů, popsat oblast pracovně právních vztahů. Ze začátku se práce obecně zaměřuje na pracovněprávní vztahy, následně subjekty a atypické pracovněprávní vztahy. Další kapitola se již věnuje agenturnímu zaměstnávání, a je v ní obecně charakterizováno agenturní zaměstnávání, následně základní pojmy související s touto problematikou a subjekty agenturního zaměstnávání. Kromě toho je uveden i právní vývoj agenturního zaměstnávání, jeho právní úprava a judikatura, porovnání agenturního zaměstnávání se Slovenskem a návrhy de lege ferenda. Další kapitola se zaměřuje na smluvní vztahy, které jsou uzavřeny mezi agenturou práce a zaměstnancem. V ní je čtenářům popsána pracovní smlouva a její typy. Dále dohoda o pracovní činnosti, pracovní poměr, písemný pokyn a dohoda o dočasném přidělení zaměstnance agentury práce. Na závěr je provedeno shrnutí zjištěných poznatků.

Abstract:

This thesis focuses on the topic of "agency worker employment contract". Its aim is to describe the field of labour relations on the basis of studying literature and internet sources. At the beginning, the thesis focuses on employment relationships in general, followed by subjects and atypical employment relationships. The next chapter is devoted to agency employment and characterises agency employment in general, followed by the basic concepts related to this issue and the subjects of agency employment. In addition, the legal development of agency employment, its regulation and case law, a comparison of agency employment with Slovakia and de lege ferenda proposals are presented. The next chapter focuses on the contractual relations that are concluded between the employment agency and the employee. In it, the reader is introduced to the employment contract and its types. Furthermore, the employment agreement, the employment relationship, the written instruction and the agreement on the temporary assignment of an employment agency employee. Finally, a summary of the findings is made.
