The ratio of direct and representative democracy in the constitutional order of the Czech Republic

Abstract:

Dané téma jsem si zvolil pro velký význam obsahové analýzy konkrétního demokratického řádu u nás, pomocí které můžeme blíže identifikovat jednotlivé nosné prvky demokratického zřízení v ČR, a blíže tak zhodnotit jeho konkrétní atributy. S ohledem na výše uvedené je totiž více než zřejmé, že samotné označení určitého státního režimu pojmem ?demokratický? o daném systému ještě mnoho nevypovídá, a pro získání konkrétnějších poznatků je nutno jej blíže zkoumat. To je významné nejen z pohledu samotného fungování našeho ústavního řádu, ale i ve významu komparativním, kdy můžeme náš demokratický systém hodnotit optikou základních principů tradičních demokratických států. Cílem práce pochopitelně není vyčerpávajícím způsobem toto téma zanalyzovat, nýbrž představit demokratický řád České republiky především z pohledu analýzy poměru přímé a zastupitelské demokracie, a to v jeho recentním pojetí i retrospektivní analýze se zaměřením na hlavní problémové okruhy této materie. Dále by práce měla nabídnout přiměřenou komparatistiku zkoumané materie v intencích vybraných demokratických států Evropy. V jednotlivých kapitolách by tak měla dát základní odpověď na otázku, jaké základní atributy jsou demokratickému systému v ČR imanentní.

Abstract:

The work is devoted to the concept of democracy. Review of the basic moments of its historical evolution and influence of major thinkers in various theories. It also mentions non-democratic forms of governance in a historical context with reference to the fact that these forms of government do not last long. It describes the basic forms of democracy - direct and indirect. It compares them and sets out the institutes today. In particular, it focuses on a comparison of direct and indirect elements of democracy in the constitutional order of the Czech Republic. It discusses their participation in selected European countries. Democracy seems to be very theoretical term, but it is a real part of the world today. From the classical Greek conception has undergone many changes and evolution will continue, and it will be influenced by the needs of current times.
