Diffusion of norms in the framework of targeted human rights sanctions

Abstract:

Bakalářská práce se zabývá difuzí norem v prostředí cílených lidskoprávních sankcí. Nejprve charakterizuje samotnou difuzi norem, vysvětluje její mechanismy a následně popisuje životní cyklus norem a jeho tři fáze. Zaměřuje se na historii sankcí s důrazem na unilaterální sankce Spojených států amerických a Velké Británie. Cílem práce je najít indicie potvrzující nebo vyvracející hypotézu, že příjímání cílené lidskoprávní legislativy je důsledkem difuze. Toho dosáhne srovnáním amerického Magnitského zákona s jeho britským ekvivalentem a popisem šíření legislativy do Evropské unie, Kanady a Austrálie. Věnuje se také faktorům, které urychlují difuzi, jako je přijetí normy kritickým počtem států, činností aktivistů nebo médií.

Abstract:

The bachelor thesis focuses on diffusion of norms in the framework of targeted human rights sanctions. First, it characterizes the diffusion of norms, explains its mechanisms and then describes the life cycle of norms and its three phases. It focuses on the history of sanctions with an emphasis on unilateral sanctions of the United States and Great Britain. The aim of this thesis is to find indications confirming or refuting the hypothesis that the adoption of targeted human rights legislation is the result of diffusion. This is achieved by comparing the American Magnitsky Act with its British equivalent and describing the spread of legislation to the European Union, Canada and Australia. Factors that accelerate diffusion, such as the adoption of norms by a critical mass of states, activism or the role of media are also addressed.
