Reorganization as a form of dealing with bankruptcy

Abstract:

Téma této diplomové práce se zaměřuje na reorganizaci jako formu řešení úpadku dlužníka. Přibližuje čtenáři zákon č. 186/2006 Sb., Insolvenční zákon, který v České republice zatím nemá dlouhou tradici. V teoretické části je popisován Insolvenční zákon a možnosti, které poskytuje při řešení úpadku dlužníka. Zejména pak poskytuje informace o průběhu reorganizace od jejího zahájení až po její skončení. V další části jsou rozebírány reorganizace společnosti Papírny Vltavský mlýn, a. s. a Kordárna, a. s. V závěru této práce jsou porovnávány průběhy popsaných reorganizací a rozbor rozdílů. Závěr je také doplněn o doporučení, jak v reorganizacích postupovat, aby byly úspěšné.

Abstract:

The theme of this thesis focuses on the reorganization as a form of the bankruptcy. It shows readers Act No. 186/2006 Coll. Insolvency Act, which in the Czech Republic still doesn´t have a long tradition. In the theoretical part is described Insolvency Act and his opportunities which are provided when debtor is in the bankruptcy. In particular, it provides information about the process of reorganization from its inception to its completion. The next section describes the reorganization of the companies Papírny Vltavský mlýn, a. s. and Kordárna, a. s. In conclusion of this thesis is compared the processes described reorganization and analysis of the differences. The conclusion is also accompanied by recommendations on how to proceed with the reorganization to be successful.
