Tax optimalization of legal entities

Abstract:

Tato diplomová práce se zabývá problematikou daňového systému ČR. Snaží se zachytit jeho strukturu a aplikaci jednotlivých daní v praxi. Hlavní část práce je věnována daňové optimalizaci právnických osob. Právě daň z příjmu fyzických a právnických osob je ve většině vyspělých zemí rozhodující složkou příjmů státního rozpočtu. Pro daňové subjekty představuje povinnost platit daně především odliv finančních prostředků, které by mohly použít efektivněji, například na rozvoj svého dalšího podnikání. Proto je jejich snahou odvádět státu na daních co nejméně a optimalizovat svou daňovou povinnost. Daňovou optimalizací ve vlastním slova smyslu pak rozumíme využití všech nástrojů, pomocí kterých lze v souladu se zákonem o dani z příjmu snižovat základ daně a minimalizovat daňovou povinnost poplatníka. Hlavním úkolem této diplomové práce je nastínit čtenáři srozumitelným způsobem, tedy na konkrétních příkladech, jednotlivé daňové instrumenty, kterými je možné snížit daňovou povinnost. Vychází se zde převážně z praktických poznatků autorky. Hlavním přínosem diplomové práce by měla být snadnější orientace poplatníka při aplikaci našich daňových zákonů v praxi a především hlubší pochopení principu fungování daně z příjmů.

Abstract:

The subject of this diploma work is the tax system in the Czech republic. The main purpose is to record the current structure of the taxation and to put down the application of the different taxes in the practical life. The fundamental part of this work is dedicated to the tax optimization for the corporations or other legal entities. Especially the income tax (also called corporate tax), in the majority of the developed economies, is representing the substantional source of the state budget revenue. Focused on the the tax payer point of view, the tax liability represents a reduction of the avaliable financial sources, which could be used in a more effective way, for example as an investment to develop the existing corporate structure. According to this fact we are facing the different efforts to lower the tax deliveries to the state and so to optimize their tax liability. Under the tax optimization is to understand the use of all legal instruments helping to reduce the tax base 0level according to the law and so to minimalize the tax laibility for the tax payer. The main target of this diploma work is to present to the reader in a clear way, it means with help of the factual examples, the different particular tax instruments, which are helping to reduce the tax laibility. The work is mainly based on the practical experience and knowledge of the author. The leading contribution of this diploma work is supposed to be an easier orientation of the tax payer by the application of current tax laws in the daily business and above all a much better understanding of the functionning of the income tax.
