The Execution of the Punitive Measure Imprisonment – selected problems

Abstract:

Tato práce se snaží poskytnout ucelený stručný vhled do problematiky patrně nejkontroverznější sankce trestního práva mladistvých a jejích základních souvislostí, především s ohledem na její účel a reálné možnosti jeho naplňování. Součástí se tak nutně vedle vymezení základních otázek týkajících se samotného výkonu stává i vymezení aspektů kriminality mládeže a jejího trestání či trestání obecně. Práce přitom nevychází jen ze samotného zákona či odborné literatury, ale čerpá informace i z každodenní praxe trestajícího aparátu. Jako součást samotné práce tak byl realizován i empirický výzkum mezi vězněnými mladistvými, zaměřený na vnímání účelnosti sankce jimi samotnými a hledání souvislostí jejich kriminálních a penitenciárních zkušeností s možností nápravy. V závěru nechybí ani nahlédnutí do právní úpravy trestání a věznění mladistvých v zahraničí či nastínění více i méně reálné budoucnosti pojednané problematiky v rámci českého práva.

Abstract:

This master thesis tries to provide a brief comprehensive view on the questions of the most controversial juvenile criminal law sanction and its basic context with an accent to its purpose and real possibilities of this purpose fulfilment. That´s why there are the specifications of juvenile criminality and juvenile sentencing as well as sentencing in general in this thesis next to the description of the basic questions of the execution itself. The sources of this thesis are not only the laws and special literature but also the information obtained from the everyday experiences of the executing authorities. One part of this work is also created as an empiric research among the juvenile prisoners, which is focused on the purposes perception of themselves and on the searching for any connections between the criminal and penitentiary experiences and the chance of reparation. At the end of this thesis you can find a part dealing with the legal regulation of juvenile justice and imprisonment abroad and the adumbration of the more or less real future of this scope in our laws.
