Abstract:

The public auctions have specific position at the market economy, where interests of business need an effective tool for selling and buying property. The public auctions belong without any doubt among these tools. Obviously such an important mean must make a part of the legal system of the Czech Republic. The history of public auctions and their regulation by the state goes back to the 18th century. Obviously the public auctions have completely different meaning in democratic society where the state respects the right of private ownership as a fundamental right than they had in the past when the economy was ruled by the state and where was not any space for private business. The political changes that happened in the year 1989 influenced also laws that in any way deal with the public auctions. First I would like to stress that my point of view regarding the public auctions comes from my experience and qualification because I work as a auctioneer. That is also the reason why I chose this topic for my thesis and why I in my thesis emphasize problems that come not only from legislation but also from my every day experiences. The main source that I work with is the law number 26/2000 Sb. that handles with the crucial issues regarding the public auctions
