Regularization as a Measure to Improve the Legal Status of Illegally / Irregularly Residing Foreigners in the Czech Republic

Abstract:

Ve své práci jsem se snažila popsat právní stav cizince v neregulárním postavení. A to s ohledem na důvody, které ho vedly k příchodu do České republiky tzn. na důvody ekonomické a humanitární. Z pohledu důvodů ekonomických jsem se snažila nastínit, jaké tito migranti mohou mít postavení na trhu práce. Z pohledu humanitárních jsou popsány instituty, které cizinec může k legalizaci pobytu z humanitárních důvodů využít. Zejména jsem se zaměřila na právo na soukromí a rodinný život a na právo non-refoulment. Práce je též věnována regularizaci jako jednomu z řešení nelegální migrace. Zde jsem shromáždila stručný přehled těchto opatření, které byly realizovány ve ostatních evropských státech. Současně jsem se zaměřila na migrační politiku České Republiky a její postoj k tomuto opatření. V závěru práce jsem stručně popsala jaké regularizační opatření by Česká republika mohla přijmout k zlepšení situace neregulérních migrantů v ČR.

Abstract:

In my work I have tried to describe the legal status of foreigners in non nonregular position . And with regard to the reasons which led to the arrival in the Czech Republic, ie . for economic and humanitarian reasons . From the economic point of view , I tried to outline what these migrants may have a position in the labor market . From the humanitarian point of view are described institutes foreigner can to legalize their residence on humanitarian grounds to use . In particular, I focus on the right to privacy and family life and the right to non – refoulement. The work is also dedicated to regularize its one of the solutions to illegal immigration. Here I gathered a brief overview of the measures that have been implemented in other European countries . At the same time , I focused on the migration policy of the Czech Republic and its position on the measure.In conclusion, I briefly described what regularization Czech Republic could take to improve the situation of irregular migrants in the country.
