Expulsion from Office of a Member of the Statutory Body and the “ne bis in idem” Principle

Abstract:

Tato diplomová práce se zaměřuje na otázku aplikace zásady zákazu dvojího trestání ve vztahu k institutu vyloučení člena statutárního orgánu z výkonu funkce jakožto soukromoprávní sankci. V první části se zabývá samotnou zásadou ne bis in idem z obecné perspektivy a rozebírá její jednotlivé prvky, v druhé části se pak zaměřuje na soudní praxi dvojího potrestání téže osoby za tentýž skutek, zejména zkoumá trestní povahu u deliktů, které nejsou formálně upraveny trestněprávními předpisy. Třetí část se zabývá otázkou, zda lze totožný skutek téže osoby, která je ve výkonu funkce obchodní společnosti, sankcionovat současně vyloučením z výkonu funkce a veřejnoprávní sankcí. Ve svém závěru se věnuje procesní stránce souběhu vícero řízení vedených proti téže osobě za totéž.

Abstract:

This thesis focuses on the question of the application of the principle of prohibition of double punishment in relation to the institute of expulsion of a member of a statutory body from the office as a private law sanction. In the first part, it deals with the “ne bis in idem” principle itself from a general perspective and analyses its individual aspects; in the second part, it focuses on the judicial practice of double punishment of the same person for the same act, in particular, it examines the punitive nature of offences that are not formally regulated by criminal law. The third part deals with the question whether the same act by the same person who is in the performance of the office of a commercial company could be sanctioned by expulsion from the office and by a public law sanction at the same time. In its conclusion, it examines the procedural aspect of the concurrence of several proceedings against the same person for the same offence.
