Tato práce pojednává o problematice pozitivních závazků státu, jejichž existenci dovozuje z Úmluvy ve svých rozhodnutích ESLP. Úvodní část práce si klade za cíl objasnit, jak se chápání konceptu pozitivních povinností státu měnilo v průběhu let a k jakým změnám docházelo v rozsahu dílčích pozitivních povinností státu dovozených z jednotlivých článků Úmluvy.
