Abstract:

Rídlová, Renáta: Prostor pro realizaci restorativního přístupu v Probační a mediační službě ČR. Brno: Masarykova univerzita, 2014. Předložená disertační práce se zabývá problematikou výkon dohledu nad dospělým pachatelem trestného činu a představami probačních pracovníků o realizaci principů restorativní justice v něm. Autorka si klade za cíl odpovědět hlavní výzkumnou otázku ve znění: „Jaký prostor skýtá deklarovaný přístup probačních pracovníků pracujících s dospělými pachateli trestných činů pro realizaci představ teorie restorativní justice?“ Autorka nejdříve vymezuje základní teoretické koncepty. Těmi jsou teorie retributivní a restorativní justice. Svou pozornost zaměřuje na naplňování či nenaplňování restorativních principů v přístupu probačních pracovníků. Dále vymezuje Probační a mediační službu ČR, jakožto organizace, v níž jsou aktivity probačního pracovníka realizovány. Popisuje výkon dohledu nad dospělým pachatelem trestného činu. Poté se autorka zabývá přístupem pracovníka vykonávajícího dohled. Poslední kapitola teoretické části práce popisuje prostor, v němž se odehrávají interakce, mezi pracovníkem a významnými druhými (v případě práce za ně považuji soudce, nadřízeného, kolegu a klienta). V metodologické části práce je popsáno pozadí realizace výzkumu. Ze závěru výzkumu vyplývá, že probačními pracovníky deklarovaný ideální i každodenní přístup v rámci realizace probačního dohledu nad dospělým pachatelem poskytuje jen omezený prostor pro realizaci představ teorie restorativní justice.

Rídlová, Renáta: An area for realization of a restorative approach in the Probation and Mediation Service of the Czech Republic. Brno: Masaryk University, 2014. This dissertation deals with the supervision of an adult offender by the probation staff and ideas on the implementation of the principles of restorative justice in it. The author aims to answer the main research question as follows: "What area offers access declared probation officers working with adult offenders for the implementation of theory of restorative justice?" The author first defines the basic theoretical concepts. These include the theory of retributive and restorative justice. It focuses attention on the fulfillment or non-fulfillment of restorative principles in the approach of probation officers. Further defines the Probation and Mediation Service of the Czech Republic, as an organization in which activities are carried out of a probation officer. Describes the supervision of an adult offender. Then the author deals with the approach of the staff supervising. The last chapter of the thesis describes the space in which interactions take place between the worker and significant others (in this case it is a judge, boss, colleagues and clients). The methodological part describes the background of the research project. The conclusion of the research shows that probation staff declared ideal everyday approach in the implementation of probation supervision of an adult offender provides only limited area for the implementation of theory of restorative justice.
